The US Department of Commerce (DOC) said that the deadline for issuing preliminary and final conclusions in administrative reviews and reviews of new exporters will be extended by up to 90 days.

According to a source from the Department of Trade Defense, the US Department of Commerce (DOC) has just announced its decision to extend the administrative processing deadline in the anti-dumping and anti-subsidy tax investigation procedure.

This is because in fiscal year 2024 (October 1, 2023, through September 30, 2024), DOC received 117 new petitions from domestic industries requesting the initiation of antidumping and/or countervailing duty investigations, exceeding the previous all-time high number of petitions filed in fiscal year 2020.

In just the first two months of fiscal year 2025 (which begins October 1, 2024), DOC has received 25 additional petitions.

Accordingly, the deadline for issuing preliminary and final conclusions in administrative reviews and reviews of new exporters will be extended by a maximum of 90 days.

This decision applies to ongoing reviews that have an opportunity to request a review before 9 December 2024. At the same time, deadlines associated with the issuance of a preliminary or final conclusion in reviews will be adjusted accordingly to the extended deadline for issuing a preliminary or final conclusion (e.g., the deadline for submitting new factual information).

However, this decision does not apply to the deadlines for the parties to submit their responses to questions, additional information, briefs and rebuttals. Individual requests for extensions will be considered on a case-by-case basis, provided that they are submitted within the prescribed deadlines. Deadlines for redetermination of tax imposition pursuant to court orders and related administrative procedures.

According to WTO statistics, the US is currently the world's leading country in investigating and applying trade defense measures to protect domestic production and is also the country that investigates and applies the most trade defense measures to Vietnam's export goods.

The total number of trade defense cases investigated by the US to date is more than 70 cases (accounting for 25% of the total number of trade defense cases against Vietnamese goods), with the main products being steel, wood, fiber, agricultural products including shrimp, tra fish, and honey.

Since the beginning of 2024, the US has initiated dozens of trade defense investigations into Vietnamese goods, including solar panels, CORE steel, fibers, paper plates, fibers, etc., not to mention dozens of annual reviews. At the same time, the number of anti-dumping tax evasion investigations has also increased rapidly.
