Building houses without permission, investing not in accordance with policy
Mr. Giang was proposed to be disciplined because when he held the position of Vice Chairman of Phu Tan District People's Committee (in 2011), he signed an official dispatch without proper authority.
The Provincial People's Committee directed the Phu Tan District People's Committee to be responsible for managing and using the Thi Tuong lagoon area strictly, in accordance with regulations, and not allowing encroachment.
Previously, the Inspectorate of the Department of Natural Resources and Environment of Ca Mau province concluded the inspection of compliance with the law on land management, use and construction of works for Dam Thi Tuong Cooperative - Ca Mau.
On October 28, 2011, Dam Thi Tuong Cooperative - Ca Mau submitted a request to the People's Committee of Phu Tan district to build three clusters of stilt houses on Dam Thi Tuong (about 400m from the edge of the lagoon for tourism).
On November 29, 2011, Mr. Vo Truong Giang (at that time, Vice Chairman of Phu Tan District People's Committee) signed and issued Official Dispatch No. 1431 on the policy of building stilt houses on Thi Tuong Lagoon as a tourist destination. Specifically, it agreed to allow the Cooperative to build three stilt houses.
On August 18, 2012, Mr. Pham Trieu Thang (at that time Mr. Thang was Vice Chairman of Phu My Commune People's Committee) signed an official dispatch approving the location for the construction of the cooperative's motel, agreeing to allow the cooperative to build an additional motel with an area of 156.2m2, including 7 rooms. Previously, from August 6 to 18, 2012, the cooperative had built two houses (a central restaurant and a kitchen).
According to the inspection conclusion, both houses invested in and built by Dam Thi Tuong Cooperative - Ca Mau were not licensed; the 7-room motel was not in accordance with the policy of Phu Tan District People's Committee for construction, because the investment object was not suitable. Specifically, Mr. Phan Tan Hung, Chairman of the Board of Directors, invested about 2 billion VND in the construction, not the Cooperative.
The approval by the People's Committee of Phu Tan district for Dam Thi Tuong - Ca Mau Cooperative to invest in construction of works on Dam Thi Tuong to serve as an eco-tourism site, aquaculture services, passenger transport, trading of goods and aquatic products, and food services is not within its authority, violating the provisions of Clause 2, Article 78 of the 2003 Land Law.
The Chairman of Phu My Commune People's Committee, following the policy of the Chairman of Phu Tan District People's Committee, approved the Cooperative to build a motel while the Cooperative did not have legal documents on land and had not been granted a construction permit, violating the law on land and construction.
As for Dam Thi Tuong Cooperative - Ca Mau, although the Chairman of Phu Tan District People's Committee and the Chairman of Phu My Commune People's Committee approved the investment in building three stilt houses on Dam Thi Tuong, the Cooperative still has to comply with legal regulations regarding land procedures and construction permits.
However, the cooperative did not comply with regulations, built houses without permission, invested in projects that were not in accordance with the policy (a row of 7-room motels), and did not have legal documents on the land.

From the above conclusion, the Inspector of the Department of Natural Resources and Environment recommended that the Director of this Department report to the Chairman of the People's Committee of Ca Mau province to direct the Chairman of the People's Committee of Phu Tan district to organize a review and clarify the responsibility of Mr. Vo Truong Giang, at the time he held the position of Vice Chairman of the People's Committee of this district, in signing Official Dispatch No. 1431.
Direct the Chairman of Phu Tan District People's Committee to organize a review and clarify the responsibility of Mr. Pham Trieu Thang, Chairman of Phu My Commune People's Committee.
Handle the responsibilities of organizations and individuals related to approving the Cooperative to build illegal works on Thi Tuong Lagoon according to regulations.
At the same time, the Cooperative and Mr. Phan Tan Hung must comply, voluntarily dismantle and relocate illegal constructions at the lagoon, and return the land to the state for management in 2024.
