The Department of Investigation Police on Corruption, Economic Crimes, and Smuggling (Ministry of Public Security) has clarified the violations of Hung Thinh Mineral Investment Corporation and prosecuted Chairman of the Board of Directors Phan Thanh Muon.
On November 7, the Ministry of Public Security announced that, based on the results of the investigation, collection of documents and evidence, on November 3, 2024, the Investigation Police Agency (Ministry of Public Security) initiated a criminal case of "Violating accounting regulations causing serious consequences; Violating regulations on research, exploration and exploitation of resources" occurring at Hung Thinh Mineral Investment Group Joint Stock Company (Hung Thinh Company) and related units. At the same time, prosecuted the accused and applied preventive measures against the following people:
Defendant Phan Thanh Muon, Chairman of the Board of Directors of Hung Thinh Company, was prosecuted for two crimes: "Violating regulations on resource exploitation" and "Violating regulations on accounting causing serious consequences", as prescribed in Clause 2, Article 227 and Clause 3, Article 221, Penal Code.
Prosecuted 6 defendants for the crime of "Violating accounting regulations causing serious consequences", stipulated in Clause 3, Article 221, Penal Code, including: Vu Duc Phuong Linh, Deputy General Director of Hung Thinh Titanium Joint Stock Company; Ngo Quang Anh, Director of Than Gia Company; Hoang Thuong Ha (Chinese nationality); Nguyen Anh Tuan, Chief Accountant of Hung Thinh Zirconium and Titanium Production Joint Stock Company; Nguyen Thi Hang, Treasurer of Hung Thinh Company; Hau Tu Doanh, sales staff of Hung Thinh Titanium Joint Stock Company.
Prosecuted 2 defendants for the crime of "Violating regulations on resource exploitation", stipulated in Clause 2, Article 227, Penal Code, including: Pham Van Duong, Executive Director of the mine of Zirconium and Titanium Production Joint Stock Company Hung Thinh; Nguyen Van Chien, General Director of Titanium Joint Stock Company Hung Thinh.
The defendants' violations were related to the exploitation of titanium ore exceeding the reserves and capacity many times over the Mineral Exploitation License granted by the Ministry of Natural Resources and Environment; Exploiting and selling raw titanium ore without processing, causing especially large losses and waste of mineral resources and tax money for the State budget.
According to the Ministry of Public Security, this is the result of implementing Resolution No. 74/2022/QH15 dated November 15, 2022 of the 15th National Assembly on promoting the implementation of policies, laws, practicing thrift, fighting waste and the direction of General Secretary To Lam on preventing and fighting waste associated with preventing and fighting corruption and negativity.
After the Supreme People's Procuracy approved, the Investigation Police Agency (Ministry of Public Security) coordinated with the Supreme People's Procuracy to serve the above-mentioned proceedings in accordance with the provisions of law.
The Investigation Agency is focusing its forces on consolidating documents and evidence of the defendants' criminal acts, expanding the investigation into related subjects to strictly handle them according to the provisions of the law; thoroughly recovering assets for the State.
