Kinhtedothi-The Ministry of Home Affairs has just proposed 5 new policies for cadres and civil servants (CBCC), notably innovating the management mechanism according to job positions (VTVL).


The Ministry of Home Affairs is seeking opinions from agencies on the proposal to draft a revised Law on Civil Servants.

In the Report submitted to the Government, the Ministry of Home Affairs said that after 5 years of amendments and supplements, some provisions of the Law on Civil Servants have revealed certain limitations and need to continue to be improved to meet the requirements of the new situation and to be researched, amended and supplemented to be consistent with the new regulations of the Party.

In particular, some provisions of the Law are not consistent with the Party's regulations as well as other specialized laws. Meanwhile, in practice, many new issues have arisen that are not regulated by law, such as specific issues on public ethics; behavioral manifestations and sanctions, handling of civil servants who violate regulations on public ethics...

According to the Ministry of Home Affairs, our Party and State are currently carrying out a revolution in streamlining the apparatus, associated with restructuring and improving the quality of the contingent of civil servants and public employees with sufficient qualities and capacity to bring the country into a "new era", an era of national development. Therefore, the requirements and mechanisms for managing and using the contingent of civil servants and public employees need to be studied and regulated in accordance with management practices in the current period.

From political and legal bases and to overcome such practical shortcomings, it is necessary to develop a Law amending and supplementing a number of articles of the Law on Civil Servants and the Law on Public Employees.

The purpose of building the Law on Public Employees (amended) is to strongly innovate the work of public employees associated with the arrangement of the apparatus of the entire political system "Simplified - compact - strong - effective - efficient - effective"; to build a team of public employees, especially leading, managing and head public employees with sufficient capacity, qualities, prestige, equal to the task; to strongly innovate the work of recruiting, training, fostering, appointing, rotating, transferring and evaluating public employees in a practical direction, on the basis of specific and measurable products.

Notably, in the draft Proposal, the Ministry of Home Affairs proposed 5 new policies, of which the highlight is the innovation of the mechanism for managing civil servants according to VTVL.

The goal of this policy is to innovate the management mechanism of civil servants from combining title standards, public employees and staffing quotas to a mechanism of managing civil servants according to public employees; using public employees as the basis for recruiting, using, evaluating, planning, training, fostering and implementing regimes and policies for civil servants; creating a competitive mechanism according to public employees based on work results, towards a truly talented civil service.

Regarding implementation solutions, this agency said it will study and amend VTVL regulations in line with the requirements of the industry and sector; gradually eliminate regulations on ranks and rank structures of civil servants; perfect the management, use and salary payment mechanism for civil servants according to VTVL. At the same time, it will study and supplement regulations allowing state agencies to sign labor contracts for some VTVL implemented and executed by civil servants, helping to be flexible in the use of human resources, especially for administrative agencies with revenue sources according to regulations.

Specifically, it will study and comprehensively revise the articles and clauses of the current Law on Civil Servants and Public Employees related to VTVL on principles of civil servant management; civil servant rights regarding salaries and salary-related regimes; regulations on civil servants and public employees at the central, provincial and district levels regarding classification of civil servants and recruitment of civil servants.

At the same time, regulations related to civil servant ranks with regulations on changing VTVL, training and fostering according to VTVL, regulations on transfer, appointment, rotation, secondment, resignation, dismissal or regulations on civil servant evaluation will be abolished. In addition, regulations on civil servant management will also be studied and revised in the direction of promoting the division of labor and decentralization in personnel work...  

In the Proposal to develop the Law on Public Employees (amended), the Ministry of Home Affairs proposed 5 important policies: innovating the mechanism for managing public employees according to VTVL; perfecting regulations on the rights and obligations of public employees, what public employees are not allowed to do, and on ethics and civil service culture; perfecting regulations to innovate the method of managing public employees in accordance with the requirements of promoting digital transformation and building a digital government, ensuring increased modernity, publicity, transparency, and efficiency in state management activities; perfecting regulations on public employee management to ensure consistency and unity with the Party's regulations and the legal system, continuing to institutionalize into law the Party's policies and guidelines on personnel work that have not yet been institutionalized; unifying the civil service from the Central to the provincial, district, and communal levels.

The Ministry of Home Affairs proposed that the Government submit to the National Assembly Standing Committee the Law on Public Employees (amended) to include in the National Assembly's 2025 Law and Ordinance Development Program and submit to the 15th National Assembly for initial comments at the 10th Session (November 2025), and for approval at the 11th Session (April 2026). The Law is expected to take effect from January 1, 2027.
