Accordingly, the method of determining the time and age limit for calculating benefits and policies is guided as follows:

1. The number of months of early retirement to calculate the one-time pension benefit for the early retirement period is the number of months calculated from the month of receiving monthly pension according to the decision of the competent authority compared to the age limit guided in Point a, Point b, Clause 5 of this Article; not exceeding 60 months.

2. The number of years of early retirement to calculate the benefit for the number of years of early retirement is the number of years calculated from the month of receiving monthly pension according to the decision of the competent authority compared to the age limit guided in Point a, Point b, Clause 5 of this Article; if there are odd months, they are rounded according to the principle: From 1 month to 6 months is counted as 0.5 years; from over 6 months to under 12 months is rounded as 1 year.

3. The time for calculating demobilization allowance and severance allowance as guided in Point a, Clause 1, Article 10, Point a, Clause 1, Article 11 and Point a, Clause 1, Article 12 of this Circular shall be implemented in accordance with the provisions in Clause 2, Article 5 of Decree No. 178/2024/ND-CP; not exceeding 60 months.

4. The time to calculate the allowance based on the number of years of work with compulsory social insurance payment as guided in Point b, Point c, Clause 1, Point b, Point c, Clause 2, Article 6; Point b, Clause 1, Article 10, Point b, Clause 1, Article 11, Point b, Clause 1, Article 12 of this Circular shall comply with the provisions in Clause 3, Article 5 of Decree No. 178/2024/ND-CP.

5. How to determine the maximum service age or retirement age for subjects to calculate early retirement policies and regimes:

a) Maximum age of service:

- For officers, comply with the provisions of Clause 2, Article 1 of the Law amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army No. 52/2024/QH15 (lieutenant 50; major 52, lieutenant colonel 54; lieutenant colonel 56; colonel 58; general 60).

- For professional soldiers, follow the provisions in Clause 2, Article 17 of the Law on Professional Soldiers, Workers and National Defense Officials No. 98/2015/QH13 (Lieutenant rank for both men and women is 52 years old; Major, Lieutenant Colonel for both men and women is 54 years old; Senior Colonel for both men and women is 56 years old and 55 years old).

- For defense workers and defense officials, follow the provisions of Article 31 of Law No. 98/2015/QH13 (men must be 60 years old and women must be 55 years old).

b) Retirement age:

- For defense civil servants; contract workers receiving salaries from the state budget; civil servants; public employees shall comply with the provisions of the Law on Social Insurance No. 41/2024/QH15; Appendix I and Appendix II issued together with Decree No. 135/2020/ND-CP dated November 18, 2020 of the Government regulating retirement age.

- For those working in cryptographic organizations under the Government Cipher Committee, comply with the provisions of Clause 1, Article 27 of the Cryptographic Law No. 05/2011/QH13; Appendix I and Appendix II issued with Decree No. 135/2020/ND-CP.

c) Military ranks to determine the maximum age limit for officers and professional soldiers:

- The military rank used to determine the highest age limit is the military rank of officers and professional soldiers recorded in the retirement decision (pre-retirement leave) of the competent authority.

d) How to determine the age of early retirement cases:

- Age to determine cases of early retirement compared to the highest service age or retirement age according to the instructions in point a, point b of this clause is calculated from the month of birth to the month immediately preceding the month of receiving monthly pension.

General Phan Van Giang , Politburo member, Deputy Secretary of the Central Military Commission, Minister of National Defense has just signed and issued Circular No. 19/2025/TT-BQP guiding the implementation of policies and regimes for subjects under the management of the Ministry of National Defense in the implementation of organizational restructuring. This Circular takes effect from the date of signing, i.e. April 11, 2025; some policies and regimes take effect from January 1, 2025 and March 15, 2025.
