The purpose of declaring assets and income and publicizing the declaration of persons with the obligation to declare is for competent agencies, organizations, units and individuals to know and grasp the status and changes of assets and income of persons with the obligation to declare in order to prevent corruption, serve personnel work, promptly detect corruption, recover corrupt assets, and prevent the dissipation of assets.
Accordingly, asset and income declaration is the recording of information on types of assets and income, changes in assets and income that must be declared, and the origin of additional assets and income according to the provisions of the 2018 Law on Anti-Corruption and Decree No. 130/2020/ND-CP of the Government.
People who are required to declare their assets and income include cadres, civil servants, police officers, army officers, professional soldiers, people holding positions of deputy head of department and equivalent or higher working at public service units, state-owned enterprises, people appointed to represent state capital in enterprises, candidates for National Assembly deputies, and candidates for People's Council deputies.
Thus, compared to the 2005 Law on Anti-Corruption, the 2018 Law on Anti-Corruption lists fewer groups of people required to declare assets and income, but in reality, the number of people required to declare is greater.
Assets and liabilities that must be declared include land use rights, houses, construction works and other assets attached to land, houses, construction works, precious metals, precious stones, money, valuable papers and other movable assets, each of which has a value of 50 million VND or more, assets and accounts abroad...
The 2018 Law on Anti-Corruption and Decree No. 130/2020/ND-CP of the Government stipulate that the method and time of declaring assets and income depend on the legal status and working position of the person holding the above positions and powers, with the principle that those who need to have their assets and income controlled must have a declaration, then depending on the working position or fluctuations in assets, that person is responsible for making an annual declaration or additional declaration...
