According to the draft, the Decree detailing the implementation of Resolution No. 170/2024/QH15 has 03 Chapters and 11 Articles regulating the adjustment of land use term recorded on the Certificate of land use rights, certificates of land use rights, house ownership rights and other assets attached to land (Certificates) issued in Da Nang city; granting Certificates of land use rights, ownership rights of assets attached to land after investors are allowed to continue using land under the project at No. 39-39B Ben Van Don (Ward 12, District 4, Ho Chi Minh City)... The Decree applies to State agencies, land users, organizations and individuals related to projects and land in the conclusions of inspections, examinations and judgments in Ho Chi Minh City, Da Nang and Khanh Hoa. The issuance of the Decree aims to promptly implement the Party's policies and directions, Resolution No. 170/2024/QH15 of the National Assembly and practical requirements to remove difficulties and obstacles related to projects and land in conclusions, inspections and judgments in Ho Chi Minh City, Da Nang, Khanh Hoa, and unleash resources for socio-economic development of localities.
The Draft Decree detailing the implementation of Resolution No. 171/2024/QH15 consists of 03 Chapters and 10 Articles regulating the pilot implementation of projects of real estate business organizations receiving land use rights; currently having land use rights; currently having land use rights and receiving land use rights; implemented on the area of production and business establishments that must be relocated due to environmental pollution, establishments that must be relocated according to construction planning, urban planning, etc. The Draft aims to create a legal corridor to manage the land use rights market, the real estate market to develop stably, healthily, openly and transparently; promote decentralization, simplify administrative procedures, contribute to promoting the country's urbanization process, and solve the people's need for residential land and housing.
At the conference, representatives of leaders of ministries, branches and localities discussed and gave specific opinions on the basic contents of the two draft decrees to ensure feasibility and effectiveness, combined with resolving projects that are still stuck and pending due to overlaps and inadequacies of the legal system, creating consistency, unity, ease of understanding and implementation.
Speaking at the conference, the Deputy Prime Minister acknowledged the comments and requested the ministries and branches, especially the Ministry of Agriculture and Environment, to seriously absorb and complete; study the calculation plan for the criteria of not exceeding 30% of the additional residential land area in the planning period in localities in the coming time when reorganizing the organizational apparatus, adjusting administrative boundaries, ensuring the principles of fairness, objectivity and science; clarify the procedures, screening criteria, and build a list of pilot projects; urgently complete the content and format of the draft decree to submit to the Prime Minister for consideration and promulgation...
