Swap working days to take 5 days off on April 30 and May 1

The Ministry of Labor, War Invalids and Social Affairs (MOLISA) has just submitted to the Prime Minister a proposal for Lunar New Year, National Day and some other holidays in 2025.

On the occasion of the Victory Day holiday of April 30 and International Labor Day of May 1, for civil servants and public employees, the Ministry of Labor, Invalids and Social Affairs proposes to swap the working day from Friday (May 2) to Saturday (April 26).

The swap plan was proposed after collecting opinions and synthesizing from 16 relevant ministries and agencies. To date, 13 ministries and agencies have participated, 100% agreeing with the plan proposed by the Ministry of Labor, Invalids and Social Affairs.

If the plan is approved by the Prime Minister, during the April 30 - May 1 holiday in 2025, civil servants and public employees will have 5 consecutive days off, from Wednesday, April 30, to Sunday, May 4, and will work as a compensatory day on Saturday, April 26.

The Ministry of Labor, Invalids and Social Affairs notes that agencies and units implementing the above holiday schedule must arrange and organize work departments reasonably to handle work continuously, ensuring good service to organizations and people.

Agencies and units that do not have a fixed weekly Saturday and Sunday off schedule must arrange a suitable holiday schedule in accordance with the law based on the specific program and plan of the unit.

According to the Ministry of Labor, Invalids and Social Affairs, the arrangement of swapping normal working days and compensating for other days not only helps ensure that civil servants and public employees have a harmonious and complete holiday, but also helps stimulate tourism and social consumption, promoting economic growth. At the same time, this swap does not change the working time fund of civil servants and public employees.

For employees working in enterprises, the drafting agency encourages employers to apply the April 30 - May 1 holiday for employees as prescribed for civil servants and public employees.

However, employers need to ensure full implementation of the regimes for employees according to the provisions of law; encourage agreements that are more beneficial to employees.

Regarding the 2025 National Day holiday , for civil servants and public employees, the Ministry of Labor, Invalids and Social Affairs chose option 1 and submitted it to the Prime Minister. Accordingly, civil servants and public employees will have the 2025 National Day holiday from Saturday, August 30, to Tuesday, September 2. Thus, with this option, on the occasion of the 2025 National Day holiday, civil servants and public employees will have 4 days off, including 2 National Day holidays and 2 weekly days off.

For employees, based on actual conditions and holiday schedules for civil servants and public employees, employers arrange the National Day holiday schedule for employees as follows: 2 days off, including September 2 of the Gregorian calendar and 1 day before or after.

If the weekly day off coincides with a holiday as prescribed by the Labor Code, the employer shall arrange a compensatory weekly day off for the employee on the next working day.

Regarding the Lunar New Year holiday schedule , the Ministry of Labor, Invalids and Social Affairs proposed a plan to take 9 consecutive days off. Specifically, the official Tet holiday schedule is from Monday, January 27, 2025, which is December 28, the year of the Dragon, through December 29 and the 3 days of the 1st, 2nd, and 3rd of Tet, which is the end of Friday, January 31, 2025.

However, immediately before the 5 official holidays are 2 weekend days, Saturday and Sunday, January 25-26, 2025, i.e. December 26 and 27 of the lunar calendar. After the official holidays come the next 2 weekend days, Saturday and Sunday, February 1-2, 2025.

Therefore, in reality, the upcoming Lunar New Year holiday will start from Saturday, January 25, 2025 to Sunday, February 2, 2025 (ie the end of January 5, At Ty year).

For businesses not included in the above categories, the Ministry of Labor, Invalids and Social Affairs requires employers to decide on one of three Tet holiday options.

One is 1 day off at the end of the year of Giap Thin and the first 4 days of the year of At Ty. Two is 2 days off at the end of the year of Giap Thin and the first 3 days of the year of At Ty. Three is 3 days off at the end of the year of Giap Thin and the first 2 days of the year of At Ty.

Employers must notify employees of the Lunar New Year holiday plan 30 days in advance.
