New developments in the copyright dispute over Miss Global 2023 in Vietnam

Regarding the dispute between MGO (Miss Global Organization) and Le Nom Vietnam Company Limited (Le Nom) about organizing the Miss Global 2023 contest in Vietnam, on the morning of January 9, MGO sent a press release clarifying related information.

According to Mr. Van M. Pham, CEO & Founder of Miss Global Organization, Miss Global Organization is the legal copyright owner of the Miss Global Contest. Miss Global is an event held in many different countries such as the Philippines, the US, Mexico, and Indonesia. 2023 is the first year Miss Global is held in Vietnam, on the occasion of the 10th anniversary of the contest's official launch.

MGO said that, because Le Nom (also known as LE NOM) violated its important obligations and did not cooperate with MGO in good faith under the Agreement to host the Miss Global 2023-2028 pageant signed between the two parties, MGO announced the termination of the Agreement with Le Nom and accordingly terminated the license for Le Nom to host Miss Global 2023-2028 in Vietnam.

MGO said that this unit sent a Notice of Contract Breach on July 16, 2023 and a Notice of Contract Termination and License to Host the Miss Global 2023-2028 Contest on August 28, 2023. The reason is that Le Nom failed to secure a venue for the Miss Global 2023 coronation night within 90 days of the Hosting Contract on July 19, 2022 and sent a copy of the signed Venue Agreement to MGO no later than October 19, 20233 according to the signed contract.

MGO said it has been trying to resolve the dispute with Le Nom for more than 30 days but Le Nom refused to honor the Hosting Contract and guarantee the venue for Miss Global 2023. Therefore, MGO terminated the Hosting Contract for Miss Global 2023-2028 and the termination is effective immediately.

According to MGO, the license granted by the competent authority to Le Nom on October 6, 2022 to organize the Miss Global 2023 contest in Ho Chi Minh City expired around mid-June 2023.

Based on the above, MGO stated that Le Nom no longer holds the License for Miss Global 2023-2028 and no longer has the right to organize the contest. Therefore, Le Nom is not allowed to use the name or represent MGO to work with partners and activities as the host of Miss Global.

After announcing the revocation of the license, MGO granted a license to supermodel Ha Anh's First Face Company Limited (First Face) to represent MGO and cooperate to organize the semi-finals of Miss Global 2023, taking place from January 3-13, 2024. On December 5, 2023, First Face was granted a license by the competent authority to organize the semi-finals of Miss Global 2023 in Phu Quoc City, Kien Giang Province.

MGO said that Le Nom's recent provision of false information has caused negative impacts. Through its representative law firm in Vietnam, MGO has sent a petition to the competent authority to request consideration and handling of Le Nom's actions.

After reviewing, the competent authority confirmed that First Face's application for permission to organize the Miss Global 2023 semi-finals is in accordance with the law. Accordingly, First Face is allowed to organize the Miss Global 2023 semi-finals in Phu Quoc City, Kien Giang Province. The semi-finals will be held according to the licensed plan and content, without delay.

To protect its legitimate rights and interests, MGO has carried out the necessary procedures to sue Le Nom in accordance with the provisions of law.

In the Notice of Termination of Contract and License to Host Miss Global 2023-2028, MGO stated that if Le Nom interferes with any other business activities or does anything that damages MGO's reputation or prevents Miss Global from organizing events in Vietnam, this will be considered as causing further damage to MGO, in which MGO will take legal measures and necessary legal actions to request non-contractual compensation worth at least 1.2 million USD (28.9 billion VND).
