The draft Law on Cultural Heritage (amended) was submitted by the Ministry of Culture, Sports and Tourism, authorized by the Government, to the National Assembly at the upcoming 7th Session. In order to complete the draft Law on Cultural Heritage (amended) as fully as possible before submitting it to the National Assembly, the Ministry of Culture, Sports and Tourism is still listening to and absorbing comments on this draft Law.

At the 32nd session, the National Assembly Standing Committee gave its opinions on the draft Law on Cultural Heritage (amended). Members of the National Assembly Standing Committee all agreed on the need to comprehensively amend the 2001 Law on Cultural Heritage (amended and supplemented in 2009) and the purpose and viewpoints of drafting the Law in the Government's Submission No. 119/TTr-CP dated March 29, 2024. The amendment of the Law aims to continue institutionalizing the Party's viewpoints and policies, overcoming difficulties and obstacles, resolving arising issues, and improving the effectiveness and efficiency of management, protection and promotion of cultural heritage values.

Members of the National Assembly Standing Committee also assessed that the draft Law on Cultural Heritage (amended) was carefully prepared and qualified to be submitted to the National Assembly for consideration. The provisions of the draft Law are basically consistent with the three policy groups submitted by the Government to the National Assembly for approval.

However, some opinions also suggested that the drafting agency continue to review and listen to opinions to complete the draft Law on Cultural Heritage (amended), ensuring consistency with current Law projects.

At the Workshop on the draft Law on Cultural Heritage (amended) organized by the Ho Chi Minh City National Assembly Delegation on April 19, there were opinions expressing interest in the content related to the establishment of a fund to purchase antiques and relics from abroad to Vietnam.

Accordingly, the delegates expressed their joy when the draft Law on Cultural Heritage (amended) this time has provisions on purchasing and bringing relics and antiques of Vietnamese origin from abroad. However, the delegates suggested that a fund should be established to purchase relics and antiques of Vietnam abroad from socialized sources.

Expressing her opinion, Ms. Huynh Ngoc Van - Director of the Ao Dai Museum proposed having a fund to promptly purchase Vietnamese antiques sold abroad, avoiding the loss of valuable antiques for the country.

Citing the fact that "Previously, countries donated artifacts but when they arrived in Vietnam, they asked for tax exemption, requiring difficult procedures" - Director of the Ao Dai Museum Huynh Ngoc Van also proposed tax exemption for individuals who bought antiques and brought them back to Vietnam instead of incentives and tax reductions as before because people had spent money to buy and bring them back but still had to pay tax, which was unreasonable.

The Director of the Ao Dai Museum also hopes that the draft law will have a strategy for training human resources for museums, while also having a treatment regime and protecting the rights of workers in the museum sector.

Proposal to have regulations to cancel relic ranking in case of natural disaster

Giving her opinion at the workshop, Lawyer Truong Thi Hoa said that in this draft law, there are more than 30 concepts, however, it is necessary to add more concepts and definitions so that people can better understand sentences and phrases such as national treasures, copies of relics, scenic spots, documentary heritage, and distorting cultural heritage, etc.

In addition, this Lawyer also proposed to add regulations on international cooperation on cultural heritage because of the global nature, national nature, the spread of cultural heritage, human rights and civil rights to cultural heritage, as well as specific regulations on proposals for restoration of cultural heritage.

"Point c, Clause 2, Article 40 stipulates: "Handling discovered relics and antiquities, organizations and individuals who discover and hand over relics and antiquities will be reimbursed for the costs of discovery and preservation and will be rewarded with an amount of money according to the provisions of law. I propose to add a specific reward level based on the appraised value" - lawyer Truong Thi Hoa commented.

Giving his opinion at the workshop, Mr. Nguyen Thanh Nhan - representative of the cultural sector of Thu Duc city proposed that there should be regulations to cancel the ranking of relics in case of natural disasters.

On behalf of the delegation of National Assembly deputies of Ho Chi Minh City, Mr. Ha Phuoc Thang - Deputy Head of the delegation of National Assembly deputies of the city recorded and summarized all the comments. These contents will be studied by the delegation as a basis for submission to the National Assembly in the next session.

It is known that the structure of the draft Law on Cultural Heritage (amended) includes 09 chapters and 102 articles, an increase of 02 chapters and 29 articles compared to the current Law (07 chapters and 73 articles). On the basis of inheriting the relevant contents of the Law on Cultural Heritage 2001, amended and supplemented in 2009, the Law on Cultural Heritage (amended) focuses on 3 groups of policies approved by the Government and the National Assembly in the dossier for proposing the Law./.
