Proposal to sentence Mr. Diep Dung to 10-11 years in prison

On the afternoon of December 28, the trial of defendant Diep Dung (former Chairman of the Board of Directors of the Ho Chi Minh City Union of Trading Cooperatives - Saigon Co.op) and four accomplices for the crime of Abuse of power while performing official duties began.

After the end of the questioning, the representative of the Ho Chi Minh City People's Procuracy expressed his opinion on the case and proposed the sentence for each defendant.

Accordingly, the representative of the prosecution agency acknowledged that Mr. Diep Dung and his accomplices had confessed honestly, repented, and partially remedied the consequences. From there, the People's Procuracy requested the panel of judges to consider reducing the sentences for the defendants appropriately.

In addition, the Procuracy determined that in addition to the assets that had been seized and confiscated, at court, Mr. Dung had a goodwill attitude and desire to continue to remedy the consequences. From there, the representative of the prosecution agency requested the panel of judges to apply Article 54 of the 2015 Penal Code (under the penalty framework - PV) to all defendants.

In this case, defendant Diep Dung and his accomplices were tried for the crimes of Abuse of power in the performance of official duties and Lack of responsibility causing serious consequences. The representative of the People's Procuracy said that the former Chairman of the Board of Directors of Saigon Co.op and his subordinates were all people with certain positions and powers, so the subject aspect of the above crimes was satisfied.

Regarding the violations, the representative of the People's Procuracy said that Mr. Dung had arbitrarily exceeded the authority of the Board of Directors in arbitrarily using 1,000 billion VND to cooperate with 2 companies and reducing the interest rate from 7% to 0%, causing a loss of more than 115 billion VND.

Regarding the motive and purpose of the crime, the representative of the prosecution agency determined that Mr. Dung worked for the common goal of Saigon Co.op and was afraid of losing capital when the two partner companies did not do business effectively, so he committed the wrongdoing.

From the above analysis, the People's Procuracy of Ho Chi Minh City affirmed that the indictment against Mr. Dung and his accomplices was correct in terms of the person and the crime, and there was no injustice.

According to the People's Procuracy, defendant Diep Dung did not go through the Board of Directors of Saigon Co.op, arbitrarily signed an investment cooperation contract with Dai A Company for VND300 billion and an investment cooperation contract with Do Thi Moi Company for VND700 billion. Mr. Diep Dung signed a payment authorization to transfer VND1,000 billion out of the VND3,000 billion that Saigon Co.op mobilized to carry out the previous acquisition of Big C to the two above companies.

According to the investment cooperation contract, Saigon Co.op receives a fixed profit rate of 7%/year, for a period of 3 months and is paid the principal and interest at the end of the cooperation period. The contract is extended for the cooperation period according to 4 appendices signed between Mr. Diep Dung, Mr. Ton That Hao and Mr. Vo Thanh Trung.

But on March 24, 2018, Mr. Diep Dung continued to not go through the board of directors, and signed an agreement to adjust the profit rate from 7%/year to 0%/year.

Mr. Dung's actions created conditions for Dai A Company and Do Thi Moi Company to not have to pay the fixed profit of 7% (including interest from loans and savings deposits of these two companies).

Mr. Dung's actions were the direct cause of Saigon Co.op's loss of 115.6 billion VND in 7% profit from the above two investment cooperation contracts.

From the above analysis, the representative of the People's Procuracy proposed that the People's Court sentence defendant Diep Dung to 10-11 years in prison for the crime of Abuse of power in the performance of official duties.

The remaining accomplices were recommended to be sentenced to 2-6 years in prison.
