The Central Inspection Commission issued Instruction No. 15, which removed points 8.1 and 8.2 in Clause 8, Section III (regulations on disciplining party members who violate population policy regulations). The two previously removed points include:
Point 8.1 "Violation due to the fact that implementing family planning measures will affect maternity health (with confirmation from a district-level hospital or equivalent or higher) will be considered for a reduced disciplinary level".
Point 8.2 "Violation due to intentional or forced failure to implement family planning will be considered for increased disciplinary action".
Instruction No. 15 adds point 8.3 in Clause 8, Section III as follows: Do not consider handling the behavior specified in Clause 2, Article 1 of Ordinance No. 08/2008/PL-UBTVQH12 dated December 27, 2008 amending Article 10 of the 2003 Population Ordinance "Giving birth to one or two children, except in special cases prescribed by the Government".
This guidance is effective as of March 20, 2025.
Previously, in February 2025, the Central Party Office sent a document to the Central Inspection Commission, the Government Party Committee, the National Assembly Party Committee, and the Ministry of Health Party Committee to notify the Politburo's opinion on the preliminary review of the implementation of Resolution No. 21-NQ/TW on population work in the new situation and amending Party and State regulations related to population policy.
The Politburo agreed on the policy of developing and implementing the National Target Program on Population and Development for the 2026-2035 period; assigned the Government Party Committee to direct the development of this Program and submit it to the National Assembly in the third quarter of 2025.
The Politburo assigned the Central Inspection Commission to advise and amend the Regulations of the Central Executive Committee, the Politburo, and the Secretariat related to handling violations of population policy and proactively amend Instruction No. 05 of the Central Inspection Commission in the direction of not disciplining cases of giving birth to a third child or more, in line with amending legal provisions (not retroactively handling cases that have been disciplined).
The Ministry of Health is drafting an Ordinance amending Article 10 of the Population Ordinance, with the proposal that each couple and individual decide on the time of childbirth, number of children and the interval between births...
