Residents of Topaz Home 2 - Block B apartments believe that the reason is that Thuan Kieu Agricultural Services and Trade Joint Stock Company (Thuan Kieu Company - the project investor) has not yet handed over the maintenance fund. For nearly 2 years, residents have sent petitions to the authorities for help, but the matter has not been thoroughly resolved.

People urge authorities to intervene

According to Mr. Nguyen Thanh Khai, Head of the Management Board of Topaz Home 2 - Block B apartment building, in 2018 he and many others signed a contract to buy and sell apartments in a social housing project at this apartment building invested by Thuan Kieu Company. In October 2020, Thuan Kieu Company began handing over apartments to buyers. In 2021, people moved into this apartment building one after another.

After the apartment building conference, on August 15, 2022, Tan Phu Ward People's Committee issued a decision to recognize the Topaz Home 2 - Block B Apartment Management Board, consisting of 1 head, 2 vice heads and 2 members. On October 10, 2022, the management board issued an official dispatch requesting Thuan Kieu Company to hand over legal documents and more than 12 billion VND of maintenance fund in accordance with regulations. From 2022 until now, the management board has requested many times but Thuan Kieu Company has not handed over the maintenance fund.

Too frustrated, the Management Board of Topaz Home 2 - Block B apartment building sent a petition to the authorities for intervention to resolve the issue. Accordingly, December 25, 2023 was the 7th time the management board of the apartment building sent a petition to the People's Committee of Ho Chi Minh City, the National Assembly Delegation of Ho Chi Minh City, the Department of Construction, and the People's Committee of Thu Duc City for help and requested to transfer the file to the Thu Duc City Police to investigate and handle Thuan Kieu Company for not handing over the maintenance fund to residents.

According to the petition of the management board, after more than 2 years of operation, systems such as fire protection, elevators, and generators have begun to break down and deteriorate but have not been maintained or repaired. This will lead to incidents, endangering the lives of 600 households living here.

More worryingly, the fire protection system was not maintained, so there were signs of false fire alarms, and the entire system showed signs of rust and severe damage.

"With the current state of the fire prevention system, if an unfortunate fire breaks out in the apartment building, we don't know what will happen. The lives of 600 households living in the apartment building are being threatened. We urgently request the authorities to intervene to ensure the lives of the people," Mr. Khai shared.

Investors and management board have not found common ground?

Regarding the failure to hand over the maintenance fund of Topaz Home 2 - Block B apartment building, on February 23, 2023, Tan Phu Ward People's Committee organized a meeting between the management board, the investor and relevant agencies.

At this meeting, Mr. Bui Thanh Binh (representative of the investor) requested the management board to set up an account in accordance with legal regulations (the account to receive the maintenance fund of the management board does not have the name of the investor who is currently the deputy manager of the management board - PV). Because the management board has not done it correctly, the investor has not transferred the maintenance fund.

Then, on August 5, 2023, Thuan Kieu Company sent a reply to the management board regarding the handover of the maintenance fund. Thuan Kieu Company stated that the management board had not followed the instructions of the Department of Construction Inspectorate on setting up an account, so there was no basis for transferring the maintenance fund.

Speaking to Thanh Nien reporter, Mr. Nguyen Thanh Khai said that the management board currently has 1 head, 2 vice heads (1 person representing the people, 1 person representing the investor) and 2 members. The maintenance fund receiving account of the management board is jointly owned by the head, vice head (representing the people) and 1 member.

According to Mr. Khai, Thuan Kieu Company claimed that the kindergarten area in the apartment building is the private property of the investor. Therefore, the requirement that the deputy manager (representative of the investor) must be the joint owner of the maintenance fund account is unfounded. At the 2022 apartment building conference, residents also agreed that the representatives of the maintenance fund account are the head of the board, the deputy manager (representative of the residents) and 1 member.

Transfer to the police if a criminal violation is detected.

On March 15, the Ho Chi Minh City National Assembly Delegation transferred the complaint of the Topaz Home 2 - Block B Apartment Management Board to the Department of Construction and Thu Duc City People's Committee for handling and responding according to their authority.

Previously, on May 24, 2023, the Ho Chi Minh City Department of Construction sent an official dispatch to the Thu Duc City People's Committee regarding the complaint of the Topaz Home 2 - Block B Apartment Management Board. The Department of Construction requested the Thu Duc City People's Committee to proactively inspect and handle violations (if any) of related individuals and organizations at the Topaz Home 2 - Block B apartment project according to its authority. In case there are signs of violations of criminal law in the management and use of maintenance funds for common property, the Thu Duc City People's Committee is requested to transfer information and documents to the police for investigation and handling.

According to the People's Committee of Thu Duc City, after receiving the complaint from the Management Board of Topaz Home 2 - Block B, Thu Duc City coordinated with relevant agencies to work with Thuan Kieu Company. The People's Committee of Thu Duc City requested Thuan Kieu Company to promptly hand over the maintenance fund to the management board. However, this company still did not hand over the maintenance fund, affecting the operation of the apartment building and the lives of residents. However, the decision to make a record and impose administrative penalties on investors who are slow to hand over the maintenance fund is under the authority of the Department of Construction.

On November 8, 2023, Thu Duc City People's Committee issued Official Dispatch No. 6836 to the Department of Construction requesting support in drawing up a record of administrative violations of the act of delay in handing over maintenance funds to the investor of Topaz Home 2 - Block B apartment building.

On December 8, 2023, the Department of Construction responded to Official Dispatch 6836 of the People's Committee of Thu Duc City. Based on Directive Dispatches 2156/UBND-DT dated June 30, 2022 and 4898/UBND-DT dated October 3, 2023 of the People's Committee of Ho Chi Minh City, the Department of Construction believes that the violation of late handover of the maintenance fund falls under the authority of the People's Committee of Thu Duc City to handle administrative violations.

Therefore, the Department of Construction requested the People's Committee of Thu Duc City to direct the specialized department to proactively draw up a record of administrative violations against the investor of Topaz Home 2 - Block B apartment building for not handing over the maintenance fund.
