On January 15, the Department of Construction of Binh Thuan province responded to Nguoi Lao Dong Newspaper regarding the handling of an illegally built villa in Tanh Linh district.
According to the Binh Thuan Department of Construction, the owner of the villa, Mr. Cao Thanh Sang (residing in Gia An commune, Tanh Linh district) requested to change the purpose of using the project to the Investment Project of the Service Area for displaying traditional ceramic products, sent to many different units.
Binh Thuan Department of Construction believes that the registered location for the project of the Service Area for displaying traditional ceramic products of Gia An brick and tile craft village, Tanh Linh district is in a rural area (not included in the urban planning). The Department of Planning and Investment is requested to consult with the People's Committee of Tanh Linh district on the orientation of socio-economic development to ensure that the project location is consistent with the General Construction Plan of Gia An commune.

Meanwhile, the Department of Planning and Investment has a written reply stating that the project is not eligible to conduct an appraisal report and submit it to the People's Committee of Binh Thuan province for consideration and resolution according to its authority, because the project investment location is not in accordance with the land use planning approved by the competent authority.
The Department of Natural Resources and Environment of Binh Thuan province said that according to the Land Use Planning for the period 2021-2030, with a vision to 2050 of Tanh Linh district approved by the Provincial People's Committee in Decision No. 201/QD-UBND dated January 30, 2023, the location of the land that Cao An One Member Co., Ltd. applied for investment registration is planned for the purpose of using land for non-agricultural production and business. Therefore, the location of the project applying for investment registration is not consistent with the land use planning approved by the competent authority.
It is known that in June 2020, Cao An Company Limited submitted an application for early impact on the brick factory project (when the permit on the current villa of Mr. Sang had not been completed) and was approved by the Chairman of the People's Committee of Tanh Linh district at that time, Mr. Nguyen Dinh Lam. Reporters of Nguoi Lao Dong Newspaper questioned whether the district leaders' agreement to construct in advance (when the permit was not yet complete) the items at Mr. Sang's villa as above was in accordance with the law or not?
Regarding this content, Binh Thuan Department of Construction said that in June 2009, Tanh Linh District People's Committee issued Plan No. 15/KHUBND on converting manual brick kilns to Hoffman kilns in the district. Accordingly, the planned area for relocating manual brick kilns to Hoffman and Tuynel kilns in Village 1, Gia An Commune was planned by the District People's Committee to move to 59 establishments in Gia An Commune. Up to now, 11 establishments have converted to Hoffman kilns and are operating in this area.
Departments and agencies in Binh Thuan have not agreed to change the function of the villa.
In June 2020, Ms. Vo Ngoc Phuong Thao, Director of Cao An One Member Co., Ltd., submitted a request for early impact on the brick factory project of Cao An One Member Co., Ltd. According to the content of the request: "Currently, Cao An One Member Co., Ltd. has been approved by the District People's Committee for the location of the brick factory investment application in Village 1, Gia An Commune in Official Dispatch No. 1061/UBND-SX dated June 19, 2019; The company is preparing the necessary documents to carry out the project such as submitting to the Provincial People's Committee for consideration of granting investment policies, leasing land, and applying for construction permits in accordance with new regulations to carry out the project.
While waiting for the completion of procedures to implement the project in accordance with regulations, in order to create conditions for the company to soon complete and put the project into operation on schedule, Cao An One Member Co., Ltd. submitted to the District People's Committee for consideration and permission to early impact the Tuynel brick factory project in Village 1, Gia An Commune.
The Chairman of the District People's Committee at that time (Mr. Nguyen Dinh Lam) wrote a note "agreeing to allow the construction of some items to serve the project while the investment dossier is being prepared; assigning the Economic and Infrastructure Department and Gia An Commune People's Committee to inspect and supervise".
“Based on Article 107 of the 2014 Construction Law (amended and supplemented by the Law amending and supplementing a number of articles of the 2020 Construction Law) on conditions for starting construction works, the Department of Construction finds that the Chairman of the Tanh Linh District People's Committee's agreement to allow the construction of a number of items serving the project as requested by Cao An One Member Co., Ltd. is not in accordance with regulations" - Binh Thuan Department of Construction replied.
Regarding the responsibility of individuals and units for the above project, according to the results of the year-end review in 2024, the collective leadership and each individual in the Standing Committee of the Gia An Commune Party Committee seriously admitted shortcomings in the leadership and direction of state management in the locality when Mr. Cao Thanh Sang's illegal construction occurred.
On December 26, the People's Committee of Binh Thuan province signed an official dispatch directing the handling of the illegally built villa of Mr. Cao Thanh Sang in village 1, Gia An commune, Tanh Linh district.
Binh Thuan Provincial People's Committee requested to notify Mr. Sang to complete the demolition of construction works violating construction order by January 15, 2025.
However, to date, the demolition of the project has not been completed.
