New policy effective from April 2025

New regulations on electronic signatures and trusted services from April 10, 2025

The Government issued Decree No. 23/2025/ND-CP regulating electronic signatures and trusted services. The Decree clearly states that electronic signature certificates are classified as follows:

+ The original digital signature certificate of the national electronic certification service provider is the digital signature certificate self-issued by the national electronic certification service provider corresponding to each type of trusted service.

+ The digital signature certificate of a trusted service provider is a digital signature certificate issued by a national electronic certification service provider to a trusted service provider corresponding to each type of trusted service, including: digital signature certificate for timestamping service, digital signature certificate for data message authentication service, digital signature certificate for public digital signature authentication service.

+ A public digital signature certificate is a digital signature certificate issued to subscribers by an organization providing public digital signature certification services.

+ A specialized electronic signature certificate is an electronic signature certificate issued by an agency or organization that creates specialized electronic signatures.

The above regulations take effect from April 10, 2025.

New regulations on management of export and import of cultural products not for business purposes

The Government issued Decree No. 31/2025/ND-CP dated February 24, 2025. This Decree takes effect from April 12, 2025.

In particular, Decree No. 31/2025/ND-CP amends and supplements Article 7 of Decree No. 32/2012/ND-CP as follows: Export of cultural products not for business purposes: Individuals and organizations with exported cultural products that have been legally produced, published, disseminated and circulated in Vietnam when exporting only carry out customs procedures according to the provisions of the law on customs, except in cases where the law provides otherwise...

Method of determining the Salary Fund of employees and the Executive Board

The Government issued Decree No. 44/2025/ND-CP dated February 28, 2025 regulating the management of labor, wages, remuneration and bonuses in state-owned enterprises.

The Decree stipulates that the salary fund of employees and the Executive Board is determined according to the following methods:

1- Determine the salary fund through the average salary level;

2- Determine the salary fund through stable salary unit price. This method is only applicable to enterprises that have been in operation for at least the expected time of applying stable salary unit price.

The above regulations take effect from April 15, 2025.

Amending regulations on policies to support tuition fees and living expenses for pedagogical students

The Government issued Decree 60/2025/ND-CP dated March 3, 2025 amending and supplementing a number of articles of Decree No. 116/2020/ND-CP dated September 25, 2020 of the Government regulating policies to support tuition fees and living expenses for pedagogical students.

In particular, Decree 60/2025/ND-CP amends and supplements Article 9 of Decree No. 116/2020/ND-CP on recovery of support funds.

Specifically, every year, based on the training and learning results of pedagogical students, teacher training institutions shall notify the list of pedagogical students who are entitled to the policy and are in the training period but have transferred to another training major, voluntarily dropped out of school, failed to complete the training program, or have been disciplined and forced to drop out of school to the People's Committee of the province where the student is a permanent resident or the agency that assigns the task or places the order to notify the recovery of the funds that have been supported for pedagogical students.

Within 30 days from the date of receipt of the notice from the competent authority, students who are eligible for reimbursement must contact the agency that issued the notice of recovery of the reimbursement to complete the procedures for reimbursement of the support funds.

The maximum period for performing the obligation to reimburse the support fund is 4 years, from the date the student teacher receives the notice of reimbursement.

The above regulations take effect from April 20, 2025.

The Central Disaster Prevention and Control Fund is established and managed by the Ministry of Agriculture and Environment.

The Government issued Decree No. 63/2025/ND-CP dated March 5, 2025 amending and supplementing a number of articles of Decree No. 78/2021/ND-CP dated August 1, 2021 of the Government on the establishment and management of the Natural Disaster Prevention and Control Fund.

According to the new regulations in Decree No. 63/2025/ND-CP, the Central Disaster Prevention and Control Fund is established and managed by the Ministry of Agriculture and Environment. (Previously, according to Decree No. 78/2021/ND-CP, the Central Fund was established by the Government and managed by the Ministry of Agriculture and Rural Development).

Decree No. 63/2025/ND-CP takes effect from April 19, 2025./.

Regulations on bank guarantee fees from April 1, 2025

On December 31, 2024, the State Bank of Vietnam issued Circular 61/2024/TT-NHNN regulating bank guarantees.

Accordingly, the bank guarantee fee from April 1, 2025 is regulated as follows:

Credit institutions and foreign bank branches shall agree on the guarantee fee with customers and related parties (if any) and must publicly post the guarantee fee.

In case of co-guarantee, the parties participating in the co-guarantee shall agree on the guarantee fee for each co-guarantor.

In case a credit institution or foreign bank branch guarantees a joint obligation, the credit institution or foreign bank branch shall agree with each customer on the fee payable based on the respective joint obligation of each customer, unless the parties have another agreement.

In case the guarantee currency is foreign currency, the parties agree to collect the guarantee fee in foreign currency or convert it into Vietnamese Dong at the selling rate of the guarantor at the time of fee collection or at the time of fee collection notice.

The parties may agree to adjust the guarantee fee.

Each teacher does not hold more than 2 positions.

The Ministry of Education and Training issued Circular No. 05/2025/TT-BGDDT dated March 7, 2025 regulating the working regime for general education and university preparatory teachers.

Circular No. 05/2025/TT-BGDDT stipulates that the actual teaching time of secondary and high school teachers is 35 weeks instead of 37 weeks for teaching and educational activities as previously regulated. At the same time, 2 reserve weeks are added for teachers to complete educational content in the general education program.

Circular No. 05/2025/TT-BGDDT clearly states that each teacher cannot hold more than 2 concurrent positions (including concurrent professional work, Party work, mass organizations, other organizations and some other job positions).

Labor classification standards according to working conditions from April 1, 2025

According to Circular 03/2025/TT-BLDTBXH dated February 11, 2025, working conditions include 6 types and are divided as follows:

- Occupations and jobs with working conditions classified as types I, II, III are occupations and jobs that are not heavy, non-toxic, or non-dangerous;

- Occupations and jobs with working conditions classified as type IV are arduous, toxic and dangerous;

- Occupations and jobs with working conditions classified as types V and VI are especially arduous, toxic and dangerous.

Working conditions are assessed and classified according to 3 methods:

- The evaluation and scoring method is implemented according to the following process: Identify the name of the occupation and job to be evaluated, determine the working conditions, and sample size. Then, evaluate the working conditions according to the system of indicators on working conditions.

- Statistical and empirical methods: Based on the characteristics of the specific working conditions of each occupation and job in the List of arduous, toxic, dangerous and especially arduous, toxic, dangerous occupations and jobs to determine the type of working conditions for the occupations and jobs being assessed.

- Combined method: Combine evaluation and scoring methods with statistical methods, experience and opinions from industry managers, experts and scientists to synthesize results.

The above regulation takes effect from April 1, 2025.
