Continuing the 8th session, on the afternoon of November 21, the National Assembly discussed in the hall the draft Resolution on the organization of urban government in Hai Phong City. Vice Chairman of the National Assembly Nguyen Khac Dinh chaired the meeting.
Removing obstacles for Hai Phong to develop dynamically
According to the Government's Submission to the National Assembly, the necessity of developing the Resolution is that Hai Phong City is a centrally-governed city, a key economic development center, especially the marine economy of the Northern region and the whole country; an educational, medical and scientific and technological center of the Northern coastal region, an important traffic hub, connecting international maritime traffic routes; located in the development triangle of Hanoi - Hai Phong - Quang Ninh; has an important strategic position in terms of national defense and security.
After more than 5 years of construction and development since the Politburo issued Resolution No. 45-NQ/TW, Hai Phong City has achieved important achievements and results in socio-economic development and ensuring national defense and security. In addition to the achieved results, the model of local government organization and regulations on tasks, powers, and operating mechanisms of local governments at all levels in the city are currently not suitable to the requirements and tasks of state management in a dynamically developing area. The mechanism and policies on decentralization and delegation between the Central Government and Hai Phong City and between local government levels in the city are still inadequate, especially the mechanisms and policies on finance, budget; planning; investment plans; organizational apparatus; urban construction and management, etc.
From there, it is necessary to organize a streamlined, reasonable, effective and efficient urban government apparatus, promote autonomy, self-responsibility, publicity and transparency in management and better serve the people of local governments at all levels of the City.
Applying Thu Duc city model to Thuy Nguyen city
Participating in the discussion at the hall, delegate Nguyen Quang Huan - National Assembly Delegation of Binh Duong province agreed with the Government's Proposal. To complete the draft, the delegate said that the current resolution sets out the coordination regulations of the authorities at all levels with the Fatherland Front at the same level, but only mentions the election, not the functions of supervision and inspection.
According to the delegate, when abolishing the People's Council at the local government level, in order to effectively implement the Law on Democracy Implementation at the Grassroots Level, the draft resolution needs to add a provision that there must be a coordination mechanism, because at that time the inspection and supervision functions of the People's Council may be partially transferred to the Fatherland Front agencies, thus maintaining activities at the grassroots level in a more democratic manner as prescribed by law.
Expressing his opinion, delegate Pham Van Hoa - National Assembly Delegation of Dong Thap province said that the National Assembly has allowed the implementation of urban government in Ho Chi Minh City and Da Nang. Therefore, the implementation of urban government in Hai Phong city is very suitable and reasonable.
Agreeing with the model of Hai Phong urban government as in the draft, the delegate said that, like Ho Chi Minh City and Da Nang, the urban government only has the city level, in which the city level includes the People's Council and the People's Committee. There is no People's Council at the district level and the People's Council at the ward level, but only the People's Committee at the district level and the People's Committee at the ward level.
Regarding the responsibilities and powers of the Chairman of the People's Council of the cities, the delegate of Dong Thap province proposed that a pilot should be conducted to ensure consistency with the content currently being piloted in Ho Chi Minh City. "It is proposed that the functions, tasks and powers of the Chairman of the City People's Committee as prescribed in Article 3 must be the same as those of the People's Committees of the two cities of Ho Chi Minh City and Da Nang. Therefore, allowing the Chairman of the City People's Committee to authorize the head of a public service unit under the City People's Committee to perform one or several tasks and powers when necessary in Point c, Clause 2, Article 3 should be piloted, because it is different from the Law on Organization of Local Government and is very suitable for the implementation of urban government in Ho Chi Minh City and Da Nang", delegate Pham Van Hoa proposed.
In addition, considering that the urban government organization model of the People's Council and People's Committee of Thuy Nguyen city is not a new model, the delegate suggested that it should be applied similarly to the model of Thu Duc city for Thuy Nguyen city. However, it should not be rigid but should be based on specific characteristics to flexibly apply this model.
Motivating Hai Phong to make new progress
Participating in the discussion, delegate La Thanh Tan - Hai Phong City National Assembly Delegation emphasized that the urban government model has a strong impact, creating momentum for Hai Phong to take a new step forward on the path of city development. The delegate also expressed hope that in the coming time, Hai Phong City will have the Government submit to the National Assembly a resolution to replace Resolution No. 35 on a number of specific mechanisms and policies for the city's development. In particular, the content of the resolution will focus on many new mechanisms and policies to continue to create breakthroughs for Hai Phong City.
Expressing his high approval, delegate Le Xuan Than - National Assembly Delegation of Khanh Hoa province expressed his concern about Article 10 of the transitional provisions in the draft Resolution. The delegate said that according to the law, the term of the National Assembly and People's Councils is 5 years. Thus, in 2026, the term of the National Assembly and People's Councils at all levels will end and the whole people will vote to elect National Assembly deputies and People's Council deputies.
Next, Article 10 of the Law on Organization of Local Government stipulates that the term of each People's Council is 5 years, from the first session of the People's Council of that term to the first session of the People's Council of the next term. At least 45 days before the end of the People's Council's term, the new People's Council must be elected. The shortening or extension of the term is decided by the National Assembly or the National Assembly Standing Committee. Regarding the term of the People's Council deputies according to the term of the People's Council, the additional elected People's Council deputies begin their duties as deputies from the opening day of the next session...
From the above analysis, delegate Le Xuan Than said that if the draft resolution includes a strict regulation that the current term of the People's Council and People's Committee of Hai Phong's districts and wards ends on June 30, 2026, it will be difficult to implement. Therefore, it is recommended that it be regulated in the direction that the implementation of this task is in accordance with the Law on Organization of Local Government, no different from the Law on Organization of Local Government.
Strengthening decentralization and delegation of power to ensure streamlined urban government
Receiving and explaining the opinions raised by National Assembly deputies, Minister of Home Affairs Pham Thi Thanh Tra said that the establishment of Hai Phong's urban government institutionalized the Party's resolution as well as the Politburo's conclusion. At the same time, during the implementation process, it ensured inheritance and synchronization with Ho Chi Minh City and Da Nang, and selected to supplement a number of issues suitable to the practical situation in the process of urban government operation of Ho Chi Minh City to suit Hai Phong.
The Minister said that in order to reduce the level of government with Hai Phong, Ho Chi Minh City and Da Nang having only one level of government and unifying a civil service regime, decentralization and delegation of power should be strengthened to ensure that the urban government is streamlined, operates dynamically, autonomously, and adapts flexibly, in accordance with the role, specific nature and characteristics of the urban area.
Regarding the name, the Minister said that in fact the name of the city within the city is also in the Law on Organization of Local Government. "We keep saying that, but in fact, to make it clear and easy to understand, in essence Thu Duc is still called Thu Duc city, and the functions, tasks, and powers of Thu Duc are different from other cities, if any, of Ho Chi Minh City in the future. Because it is a city within a city, the scale, nature, and characteristics of Thu Duc city must also be different so that it can be assessed later based on the classification basis," said Minister Pham Thi Thanh Tra.
Regarding the organizational structure of Thuy Nguyen city, the Minister said that Thuy Nguyen will be the political, economic and social center of Hai Phong city in the coming time. However, it is impossible to increase the number of officials, the number of Vice Chairmen of the People's Council and Vice Chairmen of the People's Committee as well as the committees of the Thuy Nguyen People's Council.
"At first, the plan also intended to increase the number of committees of the People's Council, increase 1 Vice Chairman of the People's Council, increase 1 Vice Chairman of the People's Committee to be similar to Thu Duc. But according to the general spirit of the General Secretary's direction to streamline, it was forced to rearrange to only two committees, which are the Socio-Economic Committee and the Urban Legal Committee," the Minister explained and said that the general spirit was to rearrange the apparatus of the People's Councils at the provincial and district levels.
The Draft Resolution has 10 articles, including: Organization of urban government in Hai Phong City (Article 1); Hai Phong City People's Council (Article 2); Duties and powers of the People's Committee and Chairman of the People's Committee of Hai Phong City (Article 3); Organizational structure, working regime, duties and powers of the District People's Committee (Article 4); People's Council of Thuy Nguyen City under Hai Phong City (Article 5); People's Committee and Chairman of the People's Committee of Thuy Nguyen City under Hai Phong City (Article 6); Organizational structure, working regime, duties and powers of the Ward People's Committee; management of cadres and civil servants of communes, wards and towns (Article 7); Organization of implementation (Article 8); Implementation provisions (Article 9) and Transitional provisions (Article 10).
