Presenting the Government's Proposal, Deputy Minister of Education and Training Pham Ngoc Thuong said that the development of the Law project aims to fully and promptly institutionalize the Party and State's guidelines, policies and strategies on teachers, especially the viewpoint that "Education development is the top national policy" and that teachers "play a decisive role in ensuring the quality of education."

In addition, perfecting a synchronous, unified, and comprehensive legal framework to create a legal basis for implementing the central and consistent goal of building and developing a team of teachers with sufficient quantity and good quality; honoring teachers and motivating teachers and learners, creating conditions for teachers to work with peace of mind, love their profession, be dedicated and responsible for their profession; contributing to perfecting the legal system on education.

The draft Law consists of 9 chapters and 71 articles; specifying 5 policies in the proposal to build the Law approved by the Government , including: Identification of teachers; Standards and titles of teachers; Recruitment, use and working regime of teachers; Training, fostering, rewarding and honoring teachers; State management of teachers.

Chairman of the National Assembly's Committee on Culture and Education Nguyen Dac Vinh, representing the examining body, said that the Standing Committee of the Committee basically agreed with the necessity of developing the draft Law on Teachers. Basically, the draft Law dossier was carefully prepared, in accordance with the provisions of the Law on Promulgation of Legal Documents, meeting the conditions for submission to the National Assembly for consideration.

Regarding some key policies, the Standing Committee agreed with the need to give real power to teachers, but requested that the drafting agency continue to research and regulate teachers' rights accurately and appropriately; regulate teachers' rights in relation to the rights of civil servants so as not to affect the rights of public teachers.

Regarding recruitment, use and evaluation of teachers (from Article 20 to Article 43), the Standing Committee of the Committee believes that assigning the authority to recruit teachers and lecturers to educational institutions aims to increase the initiative of the education sector.

However, there are concerns about the feasibility of this regulation for some types of small-scale preschool and general education facilities. Changing the authority and method of recruiting teachers compared to the provisions of the Law on Civil Servants will make it difficult to transfer and appoint teachers to other professional positions.

Regarding the policy of rewarding and honoring teachers (Articles 44, 45, 46), the Standing Committee of the Committee agreed that there should be a salary policy for teachers to motivate teachers to feel secure in their work and attract good students to the teaching profession.

However, the institutionalization of this policy needs to be consistent with the context of salary reform implementation; avoid the understanding that there will be a separate salary scale and table for teachers.

The Standing Committee believes that there should be support policies and policies to attract teachers, but it is necessary to assess the impact, identify the beneficiaries, and ensure resources to implement the policy.

There are suggestions that support and attraction policies should be reviewed to avoid duplication or omission of subjects; policies should be added to attract people with excellent academic performance to study pedagogy, and excellent students should be retained at school to become university lecturers.

Through discussion, members of the National Assembly Standing Committee highly appreciated the efforts of the drafting agency and the reviewing agency for their close coordination, serious research, and the construction of a fairly complete and legally correct draft Law.

The National Assembly Standing Committee agreed on the policy; requested the agency in charge of drafting the Government's report to focus highly on and fully absorb the opinions of the National Assembly Standing Committee and the preliminary review opinions of the Committee on Culture and Education; continue to seek opinions from experts and managers to complete the draft Law in the spirit of caution, consistency, breakthrough, practicality, efficiency and must resolve outstanding issues.

According to National Assembly Chairman Tran Thanh Man, the promulgation of the Law on Teachers needs to clarify the specific policies for teachers; whether there is a distinction between teachers and educational managers or not.

The National Assembly Chairman requested that the drafting agency listen to the opinions of those affected by the state management agency, and only stipulate issues that are mature, clear, and tested in practice. The drafting of the law must ensure caution, consistency, quality, and policy breakthroughs, but must not disrupt the structure of the current legal system.
