Many opinions expect that with innovative and progressive regulations, the laws will create momentum for socio-economic development, but there are still concerns about ensuring conditions for law enforcement, contributing to bringing the law deeper and closer to life.

Laws expected by the people

On June 29, 2024, at the 7th Session of the 15th National Assembly, the National Assembly voted to pass the Law amending and supplementing a number of articles of the 2024 Land Law, the 2023 Housing Law, the 2023 Real Estate Business Law and the 2024 Law on Credit Institutions. Thus, the 2024 Land Law, the 2023 Housing Law, and the 2023 Real Estate Business Law will take effect from August 1, 2024, 5 months earlier than the previous passage date (January 1, 2025).

In fact, the Land Law, Housing Law and Real Estate Business Law coming into effect soon is not only a wish but also a requirement of the National Assembly when voting to pass these laws.

The laws contain many innovative and progressive provisions that are expected by the people and society to create momentum for economic and social development in the new period. At the same time, many provisions in the laws can be applied immediately without the need for detailed guidance documents.

Since the laws were passed, the Government and the Prime Minister have resolutely directed ministries, branches and localities to actively and diligently develop detailed regulations and implementation guidelines.

However, some opinions suggest caution and calculating the appropriate time for the law to take effect due to concerns about the progress and roadmap for developing and issuing detailed guidance documents for the implementation of the law, which is the responsibility of the locality.

Regarding this issue, the Government affirmed before the National Assembly Standing Committee that these laws still have time for localities to complete and promulgate them according to their authority to ensure progress and quality and take effect from August 1, 2024.

More detailed regulations are needed.

 

It can be seen that the Land Law, Housing Law, Real Estate Business Law, and Credit Institutions Law have been passed, reducing many inherent pressures on businesses, helping to solve many problems that businesses have complained about for many years. That is something we are very concerned about.

Immediately after the National Assembly passed the 2024 Land Law, the 2023 Housing Law, the 2023 Real Estate Business Law and the 2024 Credit Institutions Law, many experts, businesses, and citizens expressed their support for the Government's proposal to have the laws take effect sooner. However, there are still some opinions that, in order for the laws to be well implemented, the most important requirement is that the decrees, circulars, and guiding documents must be complete and of good quality.

Sharing his joy upon hearing the news of the law's passing, Mr. Nguyen Thanh Huy (District 3, Ho Chi Minh City) hoped that the new points of the law would be actively promoted in practice, having a profound impact on many aspects of life, economy and society: "The efforts to resolve the bottlenecks shown in the newly passed laws, although not yet reaching expectations, will certainly have a positive effect. I hope the Government and relevant ministries and branches will allocate resources and the best conditions to quickly bring the law into life" - Mr. Huy said.

Also in an excited mood when hearing the news that the National Assembly passed 4 laws at the same time, Ms. Le Thi Hong Nhung (residing in Dong Da district, Hanoi) was excited: "With many provisions adjusted in the direction of protecting the maximum interests of the people, I trust and wait for the day the laws officially come into effect."

From the business perspective, Mr. Le Minh Quan - owner of a real estate company in Ho Chi Minh City, said that the Law amending and supplementing a number of articles of the 2024 Land Law, the 2023 Housing Law, the 2023 Real Estate Business Law and the 2024 Credit Institutions Law, once passed, will certainly have a positive impact on the economy in general and the real estate market in particular. The amended contents have met most of the expectations of businesses.

"This is not only a "mechanism-freedom", such as removing land price frames, selling assets on land... but also a major reform in terms of administrative procedures, eliminating intermediaries, gradually removing obstacles that businesses are currently facing such as auctions and bidding. Thereby creating conditions for businesses to access land in a more open and transparent manner" - Mr. Le Minh Quan said.

Similarly, Deputy Secretary General of the Vietnam Association of Private Entrepreneurs Nguyen Tien Thang also commented that the National Assembly's passing of the Land Law (amended) and the Law on Credit Institutions (amended) will help the business community have easier access to capital, especially cheap capital.

Affirming the Government's efforts and determination to put the laws into effect 5 months earlier, real estate expert Tran Khanh Quang emphasized that for these laws to be implemented early, the necessary and sufficient condition is that the Government, ministries and branches must have timely decrees, circulars and guiding documents that ensure quality, feasibility and convenience for local implementation.

“In fact, if all four laws are applied early, it will benefit the people, businesses and the entire economy. However, looking at the whole picture, in the context of the fear of making mistakes and fear of responsibility, and the time from now until the law takes effect on August 1, 2024 is not much, it will be the biggest challenge for the Government,” Mr. Tran Khanh Quang analyzed.

Regarding this issue, lawyer Le Thu Thao - Ho Chi Minh City Bar Association also said that the shortcomings in policy mechanisms will be resolved when the laws officially take effect on August 1. However, in order for the laws to quickly come into effect, it is important to soon complete the institution in the direction of issuing specific instructions to implement the laws.

“To avoid legal gaps and ensure that the Land Law, Housing Law, Real Estate Business Law, and Credit Institutions Law actually come into effect as soon as they come into effect, ministries, branches, and localities need to speed up the development of guiding documents with the requirement of thoroughly decentralizing to localities and minimizing administrative procedures,” said lawyer Le Thu Thao.

With the above comments, lawyer Thao proposed to assign specific tasks to each ministry and branch to develop documents to implement under the law, with specific progress, deploy training, propaganda, and dissemination of the content of the Land Law (amended), implementing documents, strengthening inspection and supervision work, etc.

 

After the Land Law, Housing Law, Real Estate Business Law, and Credit Institutions Law are promulgated, the organization and implementation of the law is an extremely important and necessary step. Therefore, it is hoped that the documents guiding the implementation of the law will be carried out as soon as possible, so that the policies will come into effect as soon as the laws come into effect.
