The Law on the Capital (amended) is expected to be considered and passed at the 7th Session.
National Assembly Chairman Vuong Dinh Hue said that the Draft Law on the Capital (amended) was discussed by the National Assembly at the 6th Session and is expected to be considered and approved at the 7th Session. This is an important draft law that is not only significant for the construction and development of the Capital but also for the whole country. This is also a difficult draft law, with specific characteristics, multi-sectoral, and has many contents different from some current laws.
According to the provisions of the Law on Promulgation of Legal Documents, after the draft Law is commented on by the National Assembly, the National Assembly Standing Committee will take the lead role in receiving, explaining, and revising the draft Law. The National Assembly Law Committee will coordinate with the National Assembly agencies and the drafting agency to advise the National Assembly Standing Committee.
To serve the March 2024 meeting of the National Assembly Standing Committee, to prepare for the upcoming 7th Session and to have an orientation to deepen the contents to be discussed and submitted to the National Assembly, the National Assembly Party Delegation worked with the Standing Committee of the Hanoi Party Committee to review the report contents, major and important contents and work to be implemented from now until the National Assembly session to ensure the best draft Law.
At the working session, National Assembly Chairman Vuong Dinh Hue requested the drafting agencies to continue to carefully review the draft contents, study the opinions of specialized ministries to the maximum extent, especially absorb important policies, guidelines and orientations of the Central Committee, the Politburo, especially of General Secretary Nguyen Phu Trong to institutionalize in the draft Law; how to ensure the Law is both feasible and consistent with the legal system.
Building the best quality Law project , creating conditions for the Capital to develop
Regarding the implementation provisions, National Assembly Chairman Vuong Dinh Hue suggested that Hanoi City coordinate with the Law Committee and the Ministry of Justice to study options to push forward the implementation of provisions that do not need guidance and propose to implement them immediately.
Regarding provisions related to staffing and organizational structure, the National Assembly Chairman proposed to amend them in a specific direction in the Law for implementation. Regarding BT projects, the National Assembly Chairman suggested to study and propose specific related forms to ensure feasibility.
Regarding the model of urban development oriented towards public transport (TOD), National Assembly Chairman Vuong Dinh Hue suggested studying and reviewing more carefully, applying diverse types as suggested by the Ministry of Construction to ensure practicality and high efficiency.
Supporting the option of clearly stating in the Law on the Capital (amended), Hanoi is a special urban area; however, regarding the controlled testing mechanism, the National Assembly Chairman suggested carefully reviewing this chapter to see whether it is necessary to make it a separate chapter or not...
In addition, National Assembly Chairman Vuong Dinh Hue directed the drafting agencies to immediately after this conference focus on completing the dossier and the Draft Law on the Capital City (amended) before the meeting of the National Assembly Standing Committee taking place this March, ensuring that the Draft Law on the Capital City (amended) is of the best quality, submitted to the National Assembly for approval, creating conditions for the development of the Capital City.
