Eliminate 'suspended' planning that makes people suffer

According to Mr. Tam, "suspended" planning not only causes waste of land resources, affects socio-economic development but also causes difficulties and disrupts people's lives.

"Residents in the "suspended" planning area live in a state of anxiety and misery, unable to leave or stay. Their rights are not properly respected. The amendment to the Land Law needs to have clear and feasible regulations to eliminate this situation," Mr. Tam emphasized. Therefore, the Kon Tum delegation proposed to remove the "vision" in planning and land use plans according to the draft, which is 10 years for district-level land use plans.

"Vision is only an estimate, a forecast, and the forecast may or may not be accurate. That can also be a factor in "suspended" planning. People only want the State to specifically determine how long the land use planning will last, or what their rights are in the planning area," Mr. Tam analyzed. He proposed adding a provision to the article on the organization of implementation of planning and land use plans: if the approved land use planning period ends without the planning or project being implemented, the planning will be canceled.

Will make planning and land use plans transparent

Also related to land use planning and plans, Deputy Tran Thi Hien (Ha Nam delegation) proposed that the draft law not stipulate that the Ministry of Natural Resources and Environment must be consulted for the task of making provincial land use plans. Ms. Hien said that provincial land use planning is already included in the national land use planning. On the contrary, when making the task of making provincial land use planning, it is based on the national land use planning and plans and other national plans.

Ha Nam delegate also proposed not to stipulate the establishment of annual land use plans at the district level in the draft law. Because in essence, annual land use plans at the district level are only for the purpose of collecting and synthesizing information, have little applicability, are very time-consuming and cause waste of resources. "In case the law still stipulates that there must be annual land use plans at the district level, I suggest that the criteria and contents of the plan should be simplified, and should not be too detailed and specific, which will cause many difficulties and problems in both the planning and implementation process," said Ms. Hien.

Explaining this issue, Minister of Natural Resources and Environment Dang Quoc Khanh said he agreed with the opinions of the delegates, how to overcome the situation of suspended planning, people having to wait. However, he said that currently, it is necessary to follow the Planning Law, making national master plans to regional and provincial planning. "The land use plans and plans will be based on these plans. Because we have to orient first, the plans will follow. If we do a good job of orienting these plans, the land use plans and plans will not be suspended", Mr. Khanh said and emphasized that it will be public and transparent for people to monitor, use, exploit and supervise the land use plans and plans.
