In the case of violating regulations on management and use of state assets causing loss and waste at the Hac Thanh Tower Project (Thanh Hoa), causing damage of more than 55 billion VND, former Secretary of the Provincial Party Committee Trinh Van Chien and former Chairman of the Thanh Hoa Provincial People's Committee Nguyen Dinh Xung each voluntarily paid 22.5 billion VND to remedy the consequences, even though they did not benefit.
Previously, the People's Procuracy of Thanh Hoa province issued an indictment to prosecute Trinh Van Chien, Nguyen Dinh Xung and 7 other defendants for the crime of "Violating regulations on management and use of state assets causing loss and waste" occurring at the Hac Thanh Tower Project (Thanh Hoa), causing damage of more than 55 billion VND.
Defendant Trinh Van Chien (former Secretary of Thanh Hoa Provincial Party Committee) heard the decision to prosecute.
At the time of the crime, which occurred before 2013, defendant Trinh Van Chien was holding the position of Chairman of the People's Committee of Thanh Hoa province. Defendant Nguyen Dinh Xung was then holding the position of Vice Chairman of the People's Committee of Thanh Hoa province.
The indictment determined that the defendants Trinh Van Chien and Nguyen Dinh Xung were responsible for deciding the land allocation price of Song Ma One Member Co., Ltd. during the equitization process.
Accordingly, defendant Trinh Van Chien agreed to let Song Ma One Member Co., Ltd. transfer the land use rights at Hac Thanh Tower Project, and agreed to apply the land allocation price at the time of January 2013 according to the 2009 land unit price, which was illegal.
Defendant Nguyen Dinh Xung signed a decision approving the land use fee paid to the State budget by this company at 21 million VND/m2, which was illegal.
In addition, defendant Xung signed to approve the enterprise value at the time Song Ma One Member Co., Ltd. was converted into Song Ma Joint Stock Company, determining the actual enterprise value did not include the value of land plot No. 3 Phan Chau Trinh (Dien Bien ward, Thanh Hoa city, Thanh Hoa province) at the time of land allocation, causing damage to the State.
Defendant Nguyen Dinh Xung (former Chairman of Thanh Hoa Provincial People's Committee) heard the decision to prosecute.
The Procuracy determined that the defendants Trinh Van Chien and Tran Dinh Xung were aware that determining the land price at the time of the land allocation decision in 2013 but applying the land price of 2009 to Song Ma One Member Co., Ltd. was illegal, but both still agreed and carried it out.
Both defendants Trinh Van Chien and Nguyen Dinh Xung were determined not to have benefited from this case. However, each of them still voluntarily paid 22.5 billion VND to remedy the consequences of the case.
The prosecution agency noted that the two defendants Chien and Xung were given mitigating circumstances such as: Honest confession, repentance, achievements in work, family with contributions to the revolution...
According to the indictment, Song Ma One Member Co., Ltd., formerly Thanh Hoa Housing Business Company (100% state capital), was assigned to manage an area of 1,733.8 square meters at No. 3 Phan Chau Trinh, Dien Bien Ward, Thanh Hoa City, Thanh Hoa Province.
During the equitization process of this enterprise, the defendants requested land allocation, implemented land allocation, and transferred land use rights for the Hac Thanh Tower Project, without determining the value of land use rights at the time of land allocation into the enterprise value, causing damage to the State of more than 55 billion VND.
The defendants' criminal acts also caused the enterprise value at the time Song Ma LLC officially converted into a joint stock company to be inaccurate; the actual enterprise value was not determined, excluding the land value.
To date, the defendants in the case have returned the entire amount of damage to remedy the consequences.
