Prepare records, monitor and strictly supervise the enforcement of civil judgments on asset recovery in criminal cases of corruption and economic crimes. Strictly supervise the verification of conditions for enforcement, classify cases that are not yet eligible for enforcement; promptly issue recommendations and protests requesting to remedy violations in the verification of conditions for enforcement and violations in the enforcement of cases that are not yet eligible for enforcement. Inspect documents verifying the assets of the person subject to enforcement, thereby determining the classification of those who are not eligible for enforcement and those who are eligible for enforcement by the enforcement agency in accordance with the provisions of law.
The Provincial People's Procuracy directed the professional department to develop topics, organize weekly online thematic study conferences from the province to 10 district-level procuracies, bring up situations and cases that have occurred in practice for discussion, and propose solutions to improve situation handling skills, and supervise the settlement of civil cases. In the work of supervising the settlement of civil cases, the Provincial People's Procuracy has closely supervised 100% of notifications of acceptance of civil cases; monitored the number of cases and cases accepted by the court for review and comparison. Directed prosecutors to strictly receive and study files to participate in court sessions, in order to detect procedural violations; grasp the content of the case, the dispute relationship, and the requests of the litigants to serve the trial work. After each trial, the participating prosecutors must report the trial results in writing to the leaders of the People's Procuracy on the developments and results of the prosecution of cases where the court's handling views are contrary to the prosecutor's views to request a solution.
In addition, the Provincial People's Procuracy has issued a plan to implement the regulations on inter-sectoral coordination with the court in the work of resolving and supervising the resolution of administrative cases, civil cases, marriage and family, commercial business, labor and other matters as prescribed by law. The People's Procuracy at two levels also strengthens coordination with the court at the same level to organize civil trials to gain experience in order to improve the skills and responsibilities of prosecutors. To effectively carry out the petition work, the Provincial People's Procuracy has directed units to strictly supervise 100% of court judgments and decisions. Assign prosecutors to promptly handle information captured through direct supervision at court sessions, through supervision of court judgments and civil decisions, through petitions, mass media and through coordination between the People's Procuracy at two levels.
In the first 6 months of 2023, the People's Procuracy at two levels accepted to supervise the settlement of 694 cases, 39 cases at first instance and 34 cases at appeal. Through the supervision work, the People's Procuracy requested the Court to verify and collect evidence in 23 cases and 1 case; the District People's Procuracy appealed 1 case at the same level, the Provincial People's Procuracy appealed 1 case at the same level; coordinated with the Provincial People's Court to organize 50 court sessions and 1 experience sharing meeting. Issued 14 recommendations requesting the court to remedy violations; 15 recommendations for relevant agencies to prevent violations. The recommendations of the People's Procuracy that were accepted exceeded the target by 10%.
To improve the quality of civil case handling supervision in the coming time, the Provincial People's Procuracy will continue to strengthen coordination between levels of supervision, between the court and the prosecution and relevant agencies in the process of handling civil cases. Special attention will be paid to inspection and professional guidance for district-level People's Procuracies, and the application of information technology in case management to improve the quality of handling cases.
