On June 2, continuing the 5th Session, the National Assembly listened to presentations and examination reports on the draft Law on Telecommunications (amended); Law on Identification.

In addition, the National Assembly discussed in the hall the draft Law amending and supplementing a number of articles of the Law on People's Public Security; the Law amending and supplementing a number of articles of the Law on Exit and Entry of Vietnamese Citizens and the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam.

Regarding the draft Law on Telecommunications (amended), Minister of Information and Communications Nguyen Manh Hung affirmed that the development of the draft Law is a complete institutionalization, in accordance with the Party's policy on developing a market economy with state regulation in telecommunications activities, developing telecommunications infrastructure and other infrastructures to create a foundation for the development of the digital economy and digital society, while overcoming institutional obstacles, policy loopholes, and inadequacies in the provisions of the 2009 Telecommunications Law and other legal provisions related to telecommunications activities, which limit the development process...

The draft Law also completes regulations on using mobile subscriber SIM accounts to pay for telecommunications services and information content services on legal mobile telecommunications networks...

Regarding new issues that need to be regulated to promote telecommunications development, Minister Nguyen Manh Hung said that the rapid development trend of telecommunications transforming into digital infrastructure with the emergence of new types of services and business models requires the completion of management regulations to promote the development of broadband telecommunications infrastructure, data center infrastructure, cloud computing in the direction of rapid, sustainable, modern, popular and energy-saving development, forming digital infrastructure...

It is necessary to specify criteria for promoting the rank of Police General before the deadline.

Regarding the draft Law amending and supplementing a number of articles of the Law on People's Public Security, the draft Law dossier was developed in accordance with the provisions of the Law on promulgation of legal documents, on the basis of summarizing practices, absorbing comments from ministries, branches, public security units, and localities, and was unanimously approved by the Government.

The draft Law amending and supplementing the regulations stipulates that public security officers who are considered for promotion from Colonel to Major General must have at least 3 years of service remaining. In cases where they do not have 3 years of service remaining, the President will decide.

Regarding this provision, delegate Trieu Thi Huyen (Yen Bai) said that in order to ensure transparency, strictness, and facilitate the application of the law, the drafting committee needs to consider and consider more specific and detailed provisions for cases where there are not enough 3 years of work left as decided by the President. Sharing the same view, delegate Dang Thi Bao Trinh (Quang Nam) said that it is necessary to have strict and unified regulations in the understanding that there are at least 36 months of work left instead of "at least 3 years of work", to avoid many different interpretations.

National Assembly deputies proposed that it is necessary to clearly define the criteria for promoting the rank of General ahead of schedule for People's Public Security officers with exceptionally outstanding achievements in combat and work.

Minister To Lam said that the Ministry of Public Security will report to the Government and relevant agencies of the National Assembly to receive, explain and complete the draft, and report to the National Assembly in accordance with regulations.

The Law on Identification Project aims to amend and supplement regulations to promote digital transformation activities in our country according to Project 06 (Project on developing applications of population data, identification and electronic authentication to serve national digital transformation in the period 2022 - 2025, with a vision to 2030).

Regarding some outstanding amendments and supplements in the draft Law, Minister of Public Security To Lam said that with the content shown on the ID card, the draft Law amends and supplements in the direction of removing fingerprints; amending regulations on information on ID card number, the words "citizen identification card", hometown, permanent residence, signature of the card issuer to personal identification number, the words "ID card", place of birth registration, place of residence...

Regarding people who are granted ID cards, the draft Law supplements regulations on management and issuance of ID cards to people under 14 years old and issuance of ID certificates to people of Vietnamese origin to ensure their legitimate rights and interests and serve state management work...

Presenting the review report, Chairman of the National Assembly's Committee on National Defense and Security Le Tan Toi said that the Committee agreed on the necessity of promulgating the Law on Identification as proposed by the Government. Regarding some specific contents, the Committee on National Defense and Security said that it is necessary to clarify further the "electronic identification" in the draft Law, because the electronic identification is explained as "electronic identification account"; at the same time, clarify the political, legal and practical basis for the subjects who are Vietnamese people without nationality living in Vietnam to match the name.

Some opinions suggested considering the content of "place of birth registration" and "place of residence" to ensure consistency. In addition, some opinions suggested specifying which information fields are mandatory, which information fields are updated according to people's needs, which information fields are only applicable to certain subjects...; stipulating that information on "blood type" and information on "iris, DNA, voice" can only be collected and updated "when requested by citizens"; for information on "occupation", it is proposed to stipulate "except for police, military and cryptography".

In addition, there are opinions suggesting considering the regulation that the subjects of ID card issuance are people under 14 years old because it is believed that the need to use ID cards of this group of subjects is very low.

Facilitation of visa policy

Giving opinions on two draft laws on immigration, delegates agreed that the provisions of the draft Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam (amended) will increase the duration of e-visas from 30 days to 3 months, valid for single or multiple entries.

The draft Law increases the temporary residence period from 15 days to 45 days for citizens of countries that Vietnam unilaterally exempts from visas and will be considered for visa issuance and temporary residence extension according to other provisions of the Law.

The Draft Law supplements the responsibilities of accommodation establishments; the obligations of foreigners in presenting their passports and valid papers of residence in Vietnam to accommodation establishments to make temporary residence declarations according to regulations... to manage the residence of foreigners in Vietnam, contributing to protecting national security and ensuring social order and safety.

Delegates agreed that increasing the temporary residence period and e-visa for foreigners is appropriate to the current situation, when the demand for long-term stay in Vietnam is increasing.

Delegate Le Nhat Thanh (Hanoi) said that, over the period of piloting e-visas from 2017 to present, the number of foreigners requesting e-visas has increased... However, the e-visa duration is short, so it has not attracted many foreigners. Therefore, the Government's proposal to increase the duration of visas and temporary residence to meet the long-term stay needs of international tourists, while creating favorable conditions for foreigners who want to enter Vietnam to research, survey the market, promote investment,... is very suitable to the practical situation.

Some opinions say that currently, Vietnam unilaterally exempts visas for citizens of 25 countries, which is much lower than that of other countries in the region. It is recommended to expand the scope and conditions for unilateral visa exemption for citizens of other countries and territories. Some opinions suggest increasing the temporary residence period to be more flexible in granting temporary residence certificates.
