According to Official Dispatch No. 472/UBTVQH15-PL of the UBTVQH, in recent times, implementing the leadership and direction of the Party Delegation of the National Assembly and the Standing Committee of the National Assembly, the work of supervising legal documents has been carried out synchronously by the agencies of the National Assembly and achieved initial positive results, promptly detecting, recommending the abolition, replacement, amendment and supplementation of illegal, contradictory, overlapping or no longer suitable provisions, contributing to enhancing the effectiveness and efficiency of law enforcement.

In addition to the achieved results, the work of supervising documents in some fields has not been carried out regularly, is still scattered, and does not closely follow the reality and requirements of key tasks of socio-economic development to remove difficulties and obstacles, and propose solutions to overcome existing problems and limitations in law enforcement.

To continue to promote the implementation of the Central Committee and Politburo's resolutions on socio-economic development, accompany the Government and the political system to overcome difficulties, strive to achieve the socio-economic development plan goals for 2023 and 5 years (2021 - 2025) at the highest level, the National Assembly Standing Committee requests the Ethnic Council and the National Assembly Committees to focus on promoting the supervision of legal documents in the fields under their responsibility, focusing on the following issues:

Ensure that the supervision of legal documents is conducted regularly, proactively and promptly in accordance with the provisions of the Law on Supervision of the National Assembly and People's Councils and Resolution No. 560/NQ-UBTVQH15 of the National Assembly Standing Committee; focus on substantive supervision of content, avoid formality, supervise with focus and key points, closely following the requirements and tasks of socio-economic development of each quarter and each year.

In particular, in 2023, it is necessary to focus on monitoring the following contents: Sub-law documents related to removing difficulties for the real estate market, corporate bonds; bidding, supply of drugs and medical equipment; handling problems in fire prevention and fighting regulations, vehicle registration, planning work, etc.

Documents in various fields have been monitored and have many recommendations and reflections from people and businesses on difficulties and obstacles in the practical implementation of laws related to issues of economic development, production, business, investment, use of capital sources, etc. that need to be resolved and removed.

Documents regulating administrative procedures, specialized inspections, and business investment conditions contain unreasonable content, causing difficulties, inconvenience, and hindering business operations; documents containing decentralization and authorization content lack clarity and conditions for implementation, and are unclear about responsibilities, inspection, and supervision mechanisms.

Review and monitor documents and regulations related to the authority and responsibility for performing public duties, licensing, investment decisions, and handling administrative procedures of people and businesses; continue to review documents to detect loopholes, inconsistencies, and inadequacies that may give rise to corruption and negativity in order to promptly rectify and overcome the situation of shirking responsibility, avoiding responsibility, working half-heartedly, and being afraid of making mistakes among a number of cadres and civil servants, especially leaders and managers at all levels.

The dispatch of the Standing Committee of the National Assembly also requested to focus on the results of monitoring legal documents, clarifying the contents with limitations, obstacles and causes of limitations and obstacles in the documents, the implementation of the documents, in which it is necessary to analyze and clearly indicate the causes due to the provisions of the law or sub-law documents having loopholes, inadequacies, contradictions, overlaps, lack of feasibility or due to the organization of law enforcement. On that basis, clearly identify the responsibilities of agencies, organizations and individuals in allowing limitations and obstacles to occur; at the same time, propose amendments, supplements, and promulgation of new documents to overcome existing shortcomings and limitations and propose solutions to enhance the effectiveness of law enforcement. For urgent issues arising in socio-economic life related to the application and enforcement of laws, it is necessary to promptly organize explanation activities at the Nationalities Council and the National Assembly Committees to take measures to rectify and remove obstacles, creating immediate changes in state management practices.

The Standing Committee of the National Assembly also proposed that, in the process of supervising legal documents, it is necessary to combine regular and ad hoc reporting. When detecting documents issued late, showing signs of illegality, inappropriate content, no longer suitable, negatively affecting socio-economic development, the Standing Committee of the Nationalities Council and the Standing Committee of the National Assembly Committees should promptly send documents to the competent agencies and persons issuing the documents requesting reports, providing information, explanations or inviting the competent agencies and persons issuing the documents to work, provide information, explain, and propose solutions. On that basis, promptly report and propose specific solutions to the Vice Chairman of the National Assembly in charge to report to the Chairman of the National Assembly, the Standing Committee of the National Assembly, and the National Assembly Party Delegation for consideration and decision on handling according to regulations, without waiting until the end of the supervision period.

At the same time, direct the Nationalities Council and the National Assembly Committees to strengthen their work with central ministries and branches to evaluate the implementation of recommendations after supervision, urge the implementation, and re-organize supervision when necessary. The Secretary General of the National Assembly shall preside over and coordinate with the Nationalities Council and the National Assembly Committees to assist the National Assembly Standing Committee in organizing the supervision of legal documents within its authority and propose specific solutions to remove difficulties and obstacles.
