The Ministry of Home Affairs has just sent the Ministry of Justice for appraisal the draft Resolution of the National Assembly Standing Committee on the reorganization of administrative units. One of the notable contents is the regulation on the consolidation of the organizational apparatus and the application of specific regimes and policies of administrative units formed after the reorganization.

Regarding the organizational structure, with the goal of stabilizing and putting the organizational structure of agencies and units after the administrative unit reorganization into operation, the draft Resolution stipulates the consolidation of the organizational structure of local governments, agencies and organizations under the People's Council, People's Committee, and public service units in administrative units after the reorganization.

Regarding staffing, the draft Resolution stipulates: The People's Committee at the provincial level shall arrange and assign cadres, civil servants, public employees, and workers of agencies and organizations after the arrangement of administrative units, ensuring simplification associated with restructuring and improving the quality of the cadres, civil servants, and public employees, in accordance with local realities.

The maximum number of cadres, civil servants and public employees of the new provincial administrative unit after the rearrangement must not exceed the total number of cadres, civil servants and public employees present at the provincial administrative units before the rearrangement.

The maximum number of cadres, civil servants and public employees of the new commune-level administrative unit after the rearrangement must not exceed the total number of cadres and civil servants present at the commune-level administrative units before the rearrangement and the number of district-level cadres, civil servants and public employees assigned to work at the new commune-level administrative unit.

The number of leaders and managers of agencies and organizations in the new provincial administrative unit after the rearrangement must not exceed the total number of leaders and managers present in the agencies and organizations in the provincial administrative unit before the rearrangement. The number of leaders and managers at agencies and organizations in the new commune-level administrative unit shall be implemented according to the instructions of the competent authority.

No later than 5 years from the effective date of the Resolution of the National Assembly on the arrangement of provincial-level administrative units and the Resolution of the National Assembly Standing Committee on the arrangement of commune-level administrative units, the number of leaders, managers, cadres, civil servants, public employees, and workers of agencies and organizations in the administrative units after the arrangement shall be basically in accordance with regulations.

The Draft Resolution also stipulates: Reserving the current salary regime, policies and position allowances (if any) of provincial, district and commune-level cadres, civil servants and public employees who are assigned to work at new provincial and commune-level administrative units for a period of 06 months. After the retention period, the regime, policies and position allowances will be implemented according to the provisions of law.

Pursuant to Government regulations, the Provincial People's Committee promptly implements policies and regimes to streamline the payroll for cadres, civil servants, public employees, and workers of agencies and organizations after administrative unit rearrangement, ensuring the correct subjects and rights and interests of cadres, civil servants, public employees, and workers affected by administrative unit rearrangement.

For specific regimes and policies (by region, area and administrative unit), the draft Resolution stipulates that the regimes and policies currently applied to the same scope and subjects as before the rearrangement. After the rearrangement, the Government will direct ministries and branches to review and propose amendments, supplements and replacements of relevant legal provisions, as a basis for adjusting the regimes and policies applied to administrative units after the rearrangement to suit the new situation.
