What documents are required to change the ownership of a motorbike?

According to Circular 24/2023/TT-BCA, when transferring vehicle ownership (selling, giving away, etc.), the vehicle owner must complete the procedure to revoke the vehicle registration and license plate at the agency managing the vehicle records; the organization or individual receiving the vehicle ownership transfer must complete the procedure to register the vehicle name change at the vehicle registration agency as prescribed.

Accordingly, the documents to be prepared are as follows:

(1) For vehicle owners (organizations and individuals transferring vehicle ownership)

Must prepare a set of documents to revoke vehicle registration and license plate including the following documents:

- Vehicle registration and license plate revocation declaration;

- Vehicle owner's documents as prescribed;

- 02 copies of engine number and chassis number;

- Vehicle registration certificate;

- License plate number;

- Copy of vehicle ownership transfer documents as prescribed (except in case of original owner transfer).

Note: In case of loss of vehicle registration certificate or license plate, the reason must be clearly stated in the registration and license plate revocation declaration.

(2) For organizations and individuals receiving vehicle ownership transfer

You must prepare a vehicle registration file including the following documents:

- Vehicle registration certificate;

- Vehicle owner's documents as prescribed;

- Vehicle ownership transfer documents as prescribed;

- Registration fee documents as prescribed;

- Certificate of registration and license plate revocation.

What documents are needed to change vehicle ownership when the previous owner cannot be found?

Pursuant to Article 31 of Circular 24/2023/TT-BCA, in case the vehicle has been transferred to many organizations or individuals and the previous owner cannot be found, the organization or individual using the vehicle must go to the agency managing the vehicle registration file to carry out the revocation procedure and register the vehicle name change at the vehicle registration agency where the head office or residence is located according to regulations; except in the case where the agency managing the file is also the agency handling the vehicle name change registration, the revocation procedure is not required.

Accordingly, in this case, organizations and individuals using the vehicle need to prepare the following documents:

- Vehicle registration certificate, clearly stating the purchase and sale process and commitment, taking responsibility for the legal origin of the vehicle;

- Vehicle ownership transfer documents of the vehicle owner and vehicle ownership transfer documents of the last seller (if any);

- Registration fee documents as prescribed;

- Certificate of revocation of vehicle registration and license plate (with a copy of the engine number and chassis number affixed and the vehicle registration authority's seal on the copy of the engine number and chassis number).

In case the agency managing the vehicle records is also the agency handling the vehicle registration transfer, the organization or individual using the vehicle shall submit the vehicle registration certificate and license plate in lieu of the registration revocation certificate and license plate.

What are the vehicle owner's documents?

(i) The vehicle owner is Vietnamese

Use a level 2 electronic identification account to carry out vehicle registration procedures on the public service portal or present your citizen identification card or passport.

For armed forces: Present People's Police ID card or People's Army ID card or certificate of confirmation from the head of the agency, working unit from regimental level, department, district-level Police or equivalent or higher (in case the armed forces ID card has not been issued).

(ii) The vehicle owner is a foreigner

- Vehicle owners who are members of diplomatic missions, consular agencies, or representative agencies of international organizations in Vietnam: Present valid diplomatic identity cards, official identity cards, consular identity cards, honorary consular identity cards, or (ordinary) identity cards, and submit a letter of introduction from the State Protocol Department or the Department of Foreign Affairs;

- In case the vehicle owner is a foreigner living and working in Vietnam (except for the subjects specified in Point a of this Clause): Present a permanent residence card or temporary residence card (with a remaining residence period in Vietnam of 06 months or more).

(iii) Vehicle owner is an organization

- Vehicle owners are organizations (except for the subjects specified in Point b, Clause 3, Article 10, Circular 24/2023/TT-BCA): Use a level 2 electronic identification account to carry out vehicle registration procedures on the public service portal; in case the organization has not been granted a level 2 electronic identification account, it must present a tax code notification or establishment decision.

In case of military enterprise vehicles, there must be an additional letter of introduction from the Department of Vehicles and Machinery, General Department of Engineering, Ministry of National Defense;

In case the vehicle operates in the automobile transportation business, there must be an additional copy of the automobile transportation business license issued by the Department of Transport, along with the original for comparison; in case the vehicle belongs to another organization or individual, there must be a vehicle rental contract, business cooperation contract, or service contract;

- Vehicle owners are diplomatic missions, consular offices and representative offices of international organizations in Vietnam: Use a level 2 electronic identification account to carry out vehicle registration procedures on the public service portal; in case the organization has not been granted a level 2 electronic identification account, it must present a tax code notification and submit a Letter of Introduction from the State Protocol Department or the Department of Foreign Affairs;

- The person introduced by the agency or organization to do the procedure must submit the vehicle owner's documents as prescribed and present personal identification documents as prescribed in Clause 1 and Clause 2, Article 10 of Circular 24/2023/TT-BCA.
