New speed limit rules coming into effect

The Ministry of Transport has just issued Circular 38/2024 regulating the speed and safe distance of motor vehicles and specialized motorbikes participating in traffic on roads.


The maximum speed on the highway is 120km/h, the minimum is 60km/h

Circular 38/2024 replaces Circular 31/2019 of the Ministry of Transport on speed and safe distance of motor vehicles and specialized motorbikes participating in traffic on roads. This Circular takes effect from January 1, 2025.

The new point of this circular is that the Ministry of Transport clearly stipulates the design speed of each type of road. In particular, the Circular stipulates that the maximum allowable operating speed on highways is 120 km/h.

The new circular stipulates that the maximum speed on highways is 120 km/h, the minimum speed is 60 km/h.

The minimum allowable operating speed on expressways is 60 km/h. In the case of expressways with a design speed of 60 km/h, the minimum operating speed shall be implemented according to the traffic organization plan approved by the competent authority.

Maximum and minimum operating speeds allowed on highways, including branch roads leading to and from highways, are determined in the traffic organization plan approved by competent authorities.

According to the Circular, highways must have signs indicating maximum operating speed and minimum operating speed.

The maximum operating speed allowed for motor vehicles on roads outside densely populated areas is as follows: Vehicles traveling outside densely populated areas are allowed to travel at a maximum speed of 90 km/h, and a minimum speed of 50 km/h, depending on the type of road.

Regarding the distance between vehicles, the circular stipulates: In dry road conditions, no fog, non-slippery road, flat terrain, straight road, guaranteed visibility, the safe distance for each speed is specified as follows:

When driving at a speed below 60 km/h, drivers and specialized motorbike operators must proactively maintain a safe distance from the vehicle in front of them; this distance depends on vehicle density and actual traffic conditions to ensure traffic safety.

In rainy, foggy, slippery road conditions, winding terrain, steep passes, and limited visibility, drivers must adjust the safe distance to be greater than the value indicated on the sign or the prescribed value.

The Ministry of Transport also allows competent authorities to "place speed limit signs based on actual conditions of the route or section". This helps localities proactively and flexibly adjust signs.
