The National Assembly Standing Committee requested the Government to urgently propose regulations on higher tax rates for people using large areas of land, many houses, and land speculators to regulate the difference in land rent resulting from State planning.

After being accepted and revised, the draft law consists of 16 chapters and 260 articles, removing 5 articles and amending and supplementing 250 articles compared to the draft law submitted to the National Assembly at the 6th session. Specifically, regarding the rights and obligations of Vietnamese people residing abroad regarding land use, there are opinions suggesting reviewing and ensuring consistency with other laws such as the Land Law, the Real Estate Business Law and the Housing Law. According to the Standing Committee of the National Assembly, the draft law amends the provisions in the direction that Vietnamese people residing abroad with Vietnamese nationality who are Vietnamese citizens have full rights related to land (not just rights to residential land) like Vietnamese citizens in the country (individuals in the country) and maintains the same policies as current laws for people of Vietnamese origin residing abroad. Therefore, the draft law amends and replaces the phrase "Vietnamese people residing abroad" with the phrase "people of Vietnamese origin residing abroad", a term used in the Nationality Law. Notably, regarding the relationship between cases of land recovery and those who are currently using land to implement socio-economic development projects (Clause 6, Article 127), the draft law is amended in the direction of prioritizing those who are currently using land. This option contributes to promoting the implementation of the orientation of commercializing land use rights; encouraging land users who are currently using land to implement investment projects in accordance with land use planning. However, the Standing Committee of the National Assembly requests the Government to urgently propose regulations on higher tax rates for those who use large areas of land, many houses, and speculate on land as required in Resolution No. 18-NQ/TW to regulate the difference in land rent obtained due to State planning. At the same time, improve the quality of investment project appraisal and investor approval; Prevent corruption and negativity. Prevent organizations and individuals from collecting land, hindering the ability of other investors with the same or better capacity to access land. Another important point is to grant Certificates to households and individuals using land without documents on land use rights who do not violate land laws and are not in cases where land is allocated without proper authority (Clause 3, Article 138). The draft law is amended in the direction of regulating the consideration of recognizing land use rights for households and individuals using land before July 1, 2024. To fundamentally solve this problem, the Standing Committee of the National Assembly proposes that the Government have mechanisms and policies to support the granting of Certificates to households and individuals using land without documents on land use rights who do not violate the law, contributing to improving the effectiveness of state management of land, ensuring the legal validity of regulations.
