The Ministry of Home Affairs has just announced the proposal to build the Law on Cadres and Civil Servants (amended) to collect opinions from relevant agencies and organizations.

In the submission, the Ministry of Home Affairs stated that after 5 years of amendment and supplementation, some provisions of the Law on Cadres and Civil Servants have revealed certain limitations and need to continue to be improved to meet the requirements of the new situation. It is necessary to study, amend and supplement them to be consistent with the new regulations of the Party.

The Minister of Home Affairs has just signed a submission to relevant ministries and agencies.

Accordingly, a number of new policies of the Party on personnel work need to continue to be institutionalized and ensured by legal regulations, including: Mechanisms and policies to attract and promote talents; Mechanisms to encourage and protect dynamic, creative cadres who dare to think, dare to do, dare to take responsibility for the common good; Mechanisms to screen and replace irresponsible cadres, civil servants, and public employees with limited capacity and low prestige.

In addition, some provisions of the Law are not consistent with the Party's regulations, such as on the authority to manage cadres and civil servants; on disciplinary action against cadres and civil servants; on the authority to decide on the establishment of civil servants.

According to the Ministry of Home Affairs, many new issues have arisen in practice that are not yet regulated by law, such as: Specific regulations on public ethics; behavioral manifestations and sanctions for officials and civil servants who violate regulations on public ethics; the application of a unified management mechanism between officials and civil servants at district level and above and officials and civil servants at commune level; regulations on admission to the civil service, including the need to add students who have graduated from the selection system; policies on job placement for leaders and managers after being disciplined.

The Ministry of Home Affairs stated that cadres and cadre work are "very important" issues, "deciding everything", "cadres are the root of all work", and are the decisive factor in the success or failure of the revolution. Currently, our Party and State are carrying out a revolution in streamlining the apparatus, associated with restructuring and improving the quality of cadres, civil servants and public employees with sufficient qualities and capacity to bring the country into a new era, an era of national development. Therefore, the requirements and mechanisms for managing and using cadres and civil servants need to be studied and regulated in accordance with management practices in the current period.

In this revision, the Ministry of Home Affairs proposed to develop 5 policies. Policy 1 is to innovate the management mechanism of cadres and civil servants according to job positions. Policy 2 is to perfect regulations on the rights and obligations of cadres and civil servants and what cadres and civil servants are not allowed to do; ethics and culture of public service.

Policy 3 is to perfect regulations to innovate methods of managing cadres and civil servants in accordance with the requirements of promoting digital transformation and building a digital government, ensuring increased modernity, publicity, transparency and efficiency in state management activities.

Policy 4 is to perfect regulations on cadre and civil servant management to ensure consistency and uniformity with Party regulations and ensure consistency with the legal system; continue to institutionalize into law the Party's policies and guidelines on cadre work that have been newly issued and have not yet been institutionalized. Policy 5 is to unify the civil service from the central level to the provincial, district and communal levels.

Regarding the policy group on innovation in the management mechanism of cadres and civil servants according to job positions, the Ministry of Home Affairs clearly stated the innovation of the management mechanism of cadres and civil servants from combining standards of titles, job positions and staffing quotas to the mechanism of managing cadres and civil servants according to job positions, taking job positions as the basis for recruitment, use, evaluation, planning, training, fostering and implementing regimes and policies for cadres and civil servants. At the same time, creating a competitive mechanism according to job positions based on work results, towards a truly talented civil service.

Regarding solutions to implement the above policy, the Ministry of Home Affairs said it will study and amend regulations on job positions in line with the requirements of the industry and field; gradually eliminate regulations on ranks and structure of civil servant ranks; and perfect the management, use and salary payment mechanism for cadres and civil servants according to job positions.

In addition, research and supplement regulations allowing state agencies to sign labor contracts for a number of enforcement and execution positions held by civil servants to create flexibility in the use of human resources, especially for administrative agencies with revenue sources according to the provisions of law.

The Ministry of Home Affairs proposed to submit to the National Assembly Standing Committee for inclusion in the National Assembly's 2025 Law and Ordinance Development Program. Submit to the 15th National Assembly for initial comments at the 10th session (November 2025) and approval at the 11th session (April 2026). The Ministry of Home Affairs proposed the expected effective date of the law from January 1, 2027.
