Proposal for Provincial Chairman to be appointed Commune Chairman after merger

(NLDO)- According to the proposal of the Ministry of Home Affairs, the Chairman of the Provincial People's Committee shall appoint the Chairman, Vice Chairman and members of the People's Committee of the commune and ward after the arrangement.

In the draft Resolution of the National Assembly Standing Committee on administrative unit arrangement, the Ministry of Home Affairs proposed regulations on arranging and perfecting the organizational apparatus of agencies and organizations after administrative unit arrangement.

Accordingly, the organization of local government after the arrangement of administrative units at the same level is implemented as follows: People's Council (PC) delegates of the old administrative units are merged into the People's Council of the new administrative unit and continue to operate until the end of their term.

In case of reorganizing the commune-level administrative unit with the ward without organizing the People's Council according to the provisions of the National Assembly's resolution on the organization of urban government, the new ward after the reorganization will continue not to organize the People's Council according to the provisions of the National Assembly's resolution on the organization of urban government. The organization of the People's Council of the ward for the 2026-2031 term shall be implemented according to the provisions of the Law on Organization of Local Government.

At the first session of the People's Council in the new provincial-level administrative unit specified in, 1 convener is appointed by the National Assembly Standing Committee to convene and preside until the People's Council elects the Chairman of the People's Council of the new administrative unit.

The People's Council of the new provincial administrative unit elects the positions of the People's Council and People's Committee according to the provisions of the Law on Organization of Local Government and operates until the new term of the People's Council is elected. The Standing Committee of the Provincial People's Council appoints the Chairman of the People's Council of the commune or ward after the arrangement.

The Ministry of Home Affairs also proposed that the Chairman of the Provincial People's Committee appoint the Chairman, Vice Chairman and members of the Commune and Ward People's Committees and arrange them to perform the tasks and powers of the Chairman of the People's Committee and the People's Committee according to the provisions of the Law on Organization of Local Government until the new People's Committee is elected.

Regarding the term of the People's Council in the new administrative unit after the rearrangement, the Ministry of Home Affairs proposes that in case the new administrative unit after the rearrangement retains the name of one of the administrative units before the rearrangement, the term of the People's Council in the administrative unit after the rearrangement will continue to be calculated according to the term of the People's Council in the administrative unit that retains the same name.

In case the new administrative unit after the rearrangement has a different name from the previous administrative units, the term of the People's Council in the new administrative unit after the rearrangement will be recalculated from the beginning (term 1) from the time of establishment.

The draft resolution also provides regulations on the organization of agencies under the People's Council, specialized agencies and other administrative organizations under the provincial People's Committee in the administrative unit after the arrangement.

Specifically, the Provincial People's Council Committees with the same functions and tasks will be merged. In case of merging a provincial administrative unit with an Ethnic Committee under the Provincial People's Council with a provincial administrative unit without an Ethnic Committee, when forming a new provincial administrative unit, the Ethnic Committee will still be organized until the end of its term.

Import the status quo of other specialized agencies and administrative organizations under the provincial People's Committee with the same functions and tasks; for other specialized agencies and administrative organizations with different functions and tasks, the establishment, reorganization and dissolution shall comply with the Government's regulations.
