The accusation is that, after the Government Inspectorate issued Conclusion 929 and Conclusion Notice No. 1103, Saigon Dai Ninh Company (SGDN) repeatedly sent petitions to the Government leaders, Ministers, Head of the Government Office, Government Inspector General, and Lam Dong Provincial People's Committee, requesting that SGDN Company be allowed to continue implementing the project.

Of these, 5 petitions were sent to the Government leaders. The Government Office, based on its operating regulations, only forwarded regular petitions to the Government Inspectorate and Lam Dong Provincial People's Committee for resolution according to their authority. The petitions were not resolved because they were unfounded, not within their authority, and were not addressed to the right subjects or had duplicate content, so they were kept.

At that time, knowing that Mr. Nguyen Cao Tri (General Director of SGDN Company) had relationships with many leaders of the Government and the Government Office, including Mr. Mai Tien Dung, Mr. Tran Van Minh (then Deputy Inspector General of the Government) "advised" Mr. Tri to ask some authorized individuals to intervene and support so that Mr. Tri could "legitimately" handle the procedures for the Dai Ninh project to be delayed and not revoked.

Comments by Mr. Mai Tien Dung

Following Mr. Minh's instructions, on October 4, 2020, Mr. Tri brought the application of SGDN Company to Hanoi to meet Mr. Mai Tien Dung to discuss the fact that Mr. Tri had bought back the Dai Ninh project, but this project had been recommended to be revoked according to the conclusion of the Government Inspectorate.

Mr. Tri asked Mr. Mai Tien Dung to write a note on the application to Department I, the Government Office to advise and report to the Government leaders for direction to transfer the application of SGDN Company to the Government Inspectorate for settlement. At that time, Mr. Mai Tien Dung wrote a note "transferring Department I" and assigned Ms. Tran Bich Ngoc, Director of Department I to report and propose. During the meeting, Mr. Nguyen Cao Tri sent a gift of 200 million VND to thank Mr. Mai Tien Dung.

Following the comments of Mr. Mai Tien Dung, Ms. Ngoc then drafted documents from the Government Office to send to the Government Inspectorate with the content of implementing the direction of the Government leaders. The Government Office transferred the petition of SGDN Company to the Government Inspectorate for consideration, settlement according to the provisions of law and response to the enterprise.

According to the indictment, because the petition of SGDN Company has not been resolved by the Government Inspectorate and the company signed a contract on October 2, 2020 to transfer 100% of SGDN Company's shares for VND 5,000 billion, Mr. Nguyen Cao Tri was instructed by Mr. Minh to continue to submit a petition to the Government Office requesting the Government leaders to issue a stronger directive in the direction of assigning the Government Inspectorate to inspect, review, and resolve the petition so that the Government Inspectorate has a basis for implementation.

On January 16, 2021, Mr. Nguyen Cao Tri met and had breakfast with Mr. Mai Tien Dung at the Guest House 35 Hung Vuong, Hanoi. Mr. Tri discussed with Mr. Mai Tien Dung that the Dai Ninh project had been revoked according to the inspection conclusion and Mr. Tri mentioned that he had bought back the project and was applying for procedures to extend the project's progress and not be revoked.

Mr. Tri also mentioned that he was instructed by Mr. Tran Van Minh to continue sending the petition of SGDN Company, through the Government Office, to report and ask for the opinion of the Government leader (in charge of the Government Inspectorate) to direct the Government Inspectorate to have a basis to establish an inspection team to verify the petition, amend the inspection conclusion, and extend the project progress.

Mr. Tri asked Mr. Dung to continue directing Department I to carry out this work. Mr. Mai Tien Dung wrote twice "transfer case I (early resolution) January 15" and "transfer case I" on the application dated January 12, 2021 of SGDN Company, and assigned it to Ms. Tran Bich Ngoc for proposal.

As a result, Department I then submitted a work resolution form on January 19, 2021, recommending that the Government leaders give their opinions to direct the Government Inspectorate to inspect, review, and resolve the reflection and recommendations of SGDN Company related to the Dai Ninh project in accordance with the provisions of law and respond to the enterprise. By October 21, 2021, the Government leaders agreed to propose the content of the above submission form.

The Supreme People's Procuracy believes that the proposal, which was later approved by the Government leaders to transfer the petition along with the direction to the Government Inspectorate to inspect and resolve it according to the request and in a direction favorable to Mr. Nguyen Cao Tri, is illegal and is the premise for a series of future violations by the Government Inspectorate.
