New points of the draft decree on driver training and testing management

Driving training centers must comply with provincial planning; driving practice vehicles must have an expiration date; driving instructors must have a teaching certificate... are new regulations in the draft Decree related to driver training and testing management.

The Ministry of Transport is seeking opinions on amending Decree No. 65/2016 on business conditions for driver training and testing services, with the aim of improving the quality of driver training and testing, contributing to reducing traffic accidents.

The testing center must comply with the planning.

The draft decree requires the construction and establishment of car driving training facilities and driving testing centers to be consistent with provincial planning, specialized planning and other relevant planning, taking into account specific factors of localities, remote areas, mountainous areas; and consistent with population density in the area. This is a new point compared to the current Decree 65.

According to the Drafting Committee, the new content is added to ensure that driving training centers are evenly distributed, suitable for the population density in the area, minimizing widespread construction investment, leading to unhealthy competition in operations and wasting social resources.

Training facility has at least 2 classrooms

The draft provides more detailed regulations on theory classrooms that must be equipped with the following contents: road traffic laws, driver ethics, traffic culture, and prevention of harmful effects of alcohol and beer. In cases where information technology equipment does not describe the road signal system or driving test, there must be drawings.

The old regulation only required training centers to have theory and practice classrooms, ensuring the quantity, technical standards, and professional expertise appropriate to the training scale according to regulations.

According to the draft, training facilities with less than 500 students must have at least 2 classrooms; from 500 to 1,000 students must have at least 4 classrooms; from 1,000 students or more must have at least 6 classrooms.

According to old regulations, a car driving training facility with a capacity of 500 students or more must have 2 classrooms for road traffic law and 2 classrooms for driving techniques; with a capacity of 1,000 students or more, it must have at least 3 classrooms for road traffic law and 3 classrooms for driving techniques.

This content is supplemented with more details than the old regulation to require training units to supplement necessary equipment to serve students and have classrooms serving less than 500 people.

Driving practice car with limited years

The draft adds regulations that driving practice vehicles of classes B1, B2 and FB have a validity period of no more than 20 years (calculated from the year of manufacture); driving practice vehicles of classes C and FC have a validity period of no more than 25 years; driving practice vehicles of classes D, E, FD and FE have a validity period of no more than 20 years.

Vehicles for testing classes B1, B2 and FB have an age limit of no more than 20 years, vehicles for testing classes C, FC, D, E, FD and FE have an age limit according to the regulations in Decree No. 95 for cargo and passenger vehicles.

In Decree 65, the age limit for driving practice and testing vehicles is not specified. According to the Drafting Committee, the addition of age limit for driving practice and testing vehicles is to ensure safety for road users in general and at the same time improve service quality.

Revoke the driving license of the learning vehicle if used for the wrong purpose.

The driving practice vehicle license shall be revoked in the following cases: the driving practice vehicle does not meet one of the prescribed conditions; is issued by an unauthorized person; is erased or modified; is used by other organizations or individuals for the purpose of driving training; the driving training facility is dissolved or has its training license revoked.

This regulation was added to tighten the management of driving practice vehicles, preventing these vehicles from being used for improper purposes.

Driving instructor standards

The draft adds that driving instructors must have a vocational teaching certificate for elementary vocational level or a level 1 pedagogical training certificate or a pedagogical certificate for elementary level teaching or equivalent or higher.

Current regulations only require teachers with elementary qualifications who meet the prescribed pedagogical standards.

Driving practice instructors must have graduated from high school or higher, have a driving license of the same class or higher than the training vehicle class, but not lower than class B2; instructors teaching classes B1, B2 must have a driving license of at least 3 years; instructors teaching classes C, D, E and F must have a driving license of at least 5 years from the date of admission; have 50,000 km of safe driving or more.

Compared to current regulations, the draft decree adds that practical drivers must have a teaching certificate and requires 50,000 km of safe driving for practical driving instructors to improve teacher quality and training quality.

Teacher's license revoked after accident

A driving instructor's license will be revoked if he/she commits fraud in training and testing to obtain a driving instructor certificate; violates teacher standards; has his/her license erased or altered; rents or lends it to others for use; or violates road traffic laws that cause serious or more serious traffic accidents.

This content is added to strictly handle violations by driving instructors.

In recent years, training facilities and driving test centers have invested in facilities, equipment, and applied science and technology to improve the quality of training and testing for driving licenses. However, training and testing in some localities still have the phenomenon of training exceeding capacity; supervision of training of driving practice instructors is not serious.

In addition, some localities have not yet inspected and supervised courses and certification exams or have only conducted them in a perfunctory manner; approved candidates for the exam who did not meet the requirements; and the exam work has not been strictly implemented in some places.

In May, the Minister of Transport issued a directive on innovation, strengthening management, preventing and combating negativity, and improving the quality of training, testing, and granting of road driving licenses.
