Kinhtedothi-Contributing to the Draft Law on Investment under the Public-Private Partnership (PPP) model, National Assembly deputies said that expanding all investment fields of PPP projects can increase opportunities for the private sector to participate more, reducing the burden on the State budget.
On the afternoon of November 6, the National Assembly discussed in the hall the draft Law amending and supplementing a number of articles of the Law on Planning, the Law on Investment, the Law on Investment under the public-private partnership model and the Law on Bidding.
The majority of delegates agreed with the need to amend four laws and said that this demonstrated the strength of the Government and the National Assembly in making breakthroughs in mechanisms and policies, unlocking resources, and removing difficulties and obstacles in the process of implementing investment and planning.
Reduce the scale of investment projects to attract resources
Commenting on the Law on Investment under the Public-Private Partnership (PPP) model, National Assembly delegate Thach Phuoc Binh (National Assembly Delegation of Tra Vinh province) said that expanding all investment areas of PPP projects can increase opportunities for the private sector to participate more, reducing the burden on the State budget. However, this needs to be based on practical assessments of pilot localities such as Hanoi, Ho Chi Minh City, and Da Nang to ensure a solid foundation for effectiveness - especially when there are challenges that have not been fully summarized from the implementation of PPP in these areas.
At the same time, the delegate said that reducing investment approval steps can shorten the implementation time but risks reducing effective control and the ability to avoid risks for the State. Therefore, the delegate suggested specifically considering the basis for eliminating these procedures and assessing the impact of this elimination to avoid arising risks. The type of BT contract in some localities has not been fully summarized, it is necessary to more clearly identify the benefits and limitations of BT contracts before legalizing them.
Regarding the increase in the maximum State capital ratio to 70% in special cases, delegates said that this regulation is reasonable. However, it is necessary to clarify the basis and criteria for application to avoid cases where the high ratio is easily abused.
Participating in the discussion, National Assembly delegate Pham Van Hoa (National Assembly delegation of Dong Thap province) stated that in the past, the mobilization of non-budgetary resources under the PPP method was still very limited, and on the other hand, the BOT cases that currently exist in localities regarding toll collection have not been completely resolved, causing difficulties for investors. Therefore, it is recommended that the State have specific and clear regulations to completely resolve these projects.
Delegates also agreed with the regulation to increase the State capital ratio to a maximum of 70% and suggested that the Government carefully consider each project to be effective and ensure the harmony of interests for investors.
National Assembly Delegate Trinh Lam Sinh (National Assembly Delegation of An Giang Province) emphasized that the Law on Investment under the Public-Private Partnership method is a field that is of great interest to businesses and has a very high demand. Therefore, the scale of investment projects under the Public-Private Partnership method should be reduced to attract more investment resources into the transport sector.
Stick to reality, free up resources, clear bottlenecks
Speaking at the meeting, Minister of Planning and Investment Nguyen Chi Dung said that the amendment of the laws closely follows the viewpoints and directions of General Secretary To Lam and National Assembly Chairman Tran Thanh Man on innovation in law-making thinking, specifically ensuring the requirements of State management; encouraging creativity, freeing up resources, clearing bottlenecks, closely following reality, not being perfectionist, not being hasty, and taking people and businesses as the center.
According to the Minister, regarding the Law on Bidding in the form of PPP, we will return to BT (build-transfer) contracts with land and BT with money - we did it before, but then stopped and let 3 provinces do it.
"With the current request of many localities, we would like to restore it but with a new, stricter management method to ensure that the interests of the State and investors are not lost and are transparent," said Minister Nguyen Chi Dung.
Regarding the BT transition, according to the Minister of Planning and Investment, this is a very complicated issue. Preliminary statistics show that there have been 160 projects worth about 59,000 billion VND, but in reality there are many more in the localities.
The Government has established a Steering Committee for this issue, including the Permanent Deputy Prime Minister as Head of the Committee and the participation of the police, courts, prosecutors, and all internal affairs agencies. This issue will be deployed to resolve and synthesize and review nationwide, in which it will be classified into groups with different violations and have a direction for handling each group.
"If we solve this problem, we will unlock huge resources for development investment, contribute immediately to budget revenue and economic growth; help many businesses remove obstacles, and create many jobs" - Minister Nguyen Chi Dung said.
According to the Minister of Planning and Investment, this is a very big problem. The Ministry has reported and asked the National Assembly for permission to issue a separate resolution to handle the policy, for each case, and not included it in this Draft Law.
