Head of the Delegation Affairs Committee of the National Assembly Standing Committee, Head of the Drafting Committee Nguyen Thi Thanh said: The drafting of the resolution aims to promptly institutionalize Regulation No. 96-QD/TW dated February 2, 2023 of the Politburo on taking a vote of confidence for leadership and management positions and titles in the political system and Resolution No. 27-NQ/TW dated November 9, 2022 of the 6th Conference of the 13th Party Central Committee on continuing to build and perfect the socialist rule-of-law state of Vietnam in the new period; ensuring the consistency of the legal system in the context that in recent years the National Assembly has amended and supplemented a number of laws related to taking a vote of confidence and voting for confidence at the National Assembly and People's Councils (PCs).  

The purpose of drafting the resolution is to promptly institutionalize the Party's policies and guidelines on personnel work and the vote of confidence for leadership and management positions in the political system; to enhance the responsibility of those who are voted for and vote for confidence, contributing to building a contingent of cadres with sufficient qualities, capacity, prestige, and equal to the task.

The drafting of a resolution on taking a vote of confidence and voting for confidence aims to contribute to building a team of cadres with sufficient qualities, capacity, prestige, and equal to the task.

The draft resolution consists of 22 articles, compared to Resolution No. 85/2014/QH13, keeping 2 articles, amending and supplementing 16 articles and adding 4 new articles; there are 7 appendices, of which 2 new appendices are added.

No vote of confidence for those awaiting retirement

Draft resolution to add subjects to vote of confidence for the position of Secretary General of the National Assembly to comply with the Law on Organization of the National Assembly and Regulation No. 96-QD/TW, adjusting a number of positions according to the Law on Organization of Local Government, amended and supplemented in 2019.

At the same time, amend and supplement the cases where a vote of confidence is not taken for those who have announced their resignation pending retirement, announced their retirement, or were appointed or elected in the year of the vote of confidence to comply with Regulation No. 96-QD/TW and the practice of taking a vote of confidence in the past.  

Add some content in the process of taking a vote of confidence

To clarify the authority and time limit of some steps in the process of taking a vote of confidence and voting for confidence at the National Assembly and People's Councils, the draft resolution has added the following contents:

- Supplementing the authority of the National Assembly Standing Committee and the People's Council Standing Committee to decide on the list of people who are subject to a vote of confidence and supplementing the regulation that within 45 days at the latest, the person subject to a vote of confidence must send a written request to the National Assembly Standing Committee and the People's Council Standing Committee to submit a Report and a Declaration of Assets and Income.

- Supplementing the regulation that the Vietnam Fatherland Front Committee collects and synthesizes voters' opinions and recommendations related to the person subject to the vote of confidence (if any) and sends them to the National Assembly Standing Committee and the People's Council Standing Committee at least 25 days before the opening date of the National Assembly session or People's Council session.

- Supplementing regulations on the meeting to take a vote of confidence, the vote of confidence can only be conducted when at least two-thirds of the total number of National Assembly deputies and People's Council deputies attend.

- Arrange and supplement the process of taking a vote of confidence in the session of taking a vote of confidence based on the corresponding regulations in the National Assembly session regulations.

- Amend the regulations on the process of voting for confidence in the National Assembly and People's Councils for consistency, accordingly, no discussion in the hall but only discussion in the National Assembly Delegation, People's Council Delegation Group and report the results to the National Assembly and People's Council.

Officials who are rated "low confidence" by more than half of delegates must resign.

Regarding the consequences for those who are given a vote of confidence, according to the draft resolution, those who are given a vote of confidence and have more than half to less than two-thirds of the total number of National Assembly deputies and People's Council deputies rate them as having "low confidence" must resign.

In case of refusal to resign, the competent agency or person that recommends that person for election or approval by the National Assembly or People's Council shall be responsible for submitting to the National Assembly or People's Council for a vote of confidence at that session or the nearest session.

For a person subject to a vote of confidence who is rated "low confidence" by 2/3 or more of the total number of National Assembly deputies or People's Council deputies, the agency or person with the authority to recommend that person for election or approval by the National Assembly or People's Council is responsible for submitting to the National Assembly or People's Council for dismissal at that session or the nearest session.

For people holding multiple positions at the same time, the vote of confidence and dismissal is carried out once for those positions.
