This issue was raised by National Assembly delegate Thach Phuoc Binh (Tra Vinh) in the morning discussion session on February 14, regarding the Draft Law on Government Organization Amendment.
Commenting on the regulations on decentralization and delegation of power, Mr. Binh suggested that there should be a clear boundary between these concepts, avoiding the situation where the Government deeply intervenes in local affairs, reducing the initiative of local authorities.
He suggested that "decentralization" means that local authorities have the right to make independent decisions in certain areas such as local economic and social development. "Decentralization" means that local authorities are assigned to perform certain tasks according to Government regulations, but are still subject to supervision.

The delegate also proposed clarifying the Prime Minister's control mechanism over ministers in case a minister performs his duties ineffectively.
In reality, there are many cases where ministers are criticized for not completing their tasks but the handling of responsibilities is not clear, Mr. Binh proposed adding a mechanism for the Prime Minister to supervise ministers. Specifically, the Prime Minister has the right to propose to the National Assembly to vote for confidence if a minister fails to complete his/her tasks, or to take measures to rectify the activities of that ministry.
Also interested in the regulations on decentralization, delegate Tran Quoc Tuan (Tra Vinh) said that this is a new way of thinking that has been legalized, which many localities are in great need of, to free up resources that are being held back by bottlenecks in mechanisms.
Mr. Tuan proposed to add to the law the responsibility of ministers and heads of ministerial-level agencies as members of the Government, submit to competent authorities for consideration and decision on decentralization to localities when there are sufficient conditions and necessary capacity, and at the same time, it is necessary to add regulations to closely monitor this content.

"Only then will decentralization be truly effective and bottlenecks removed, and resources can be best released to serve the country's socio-economic development," said Mr. Tuan.
The delegate proposed that the Government direct ministries and branches to promptly issue legal documents to guide the implementation of the law passed at this session.
In particular, according to Mr. Tuan, it is very necessary to issue a decree regulating "decentralization and delegation of power" in a clear, transparent and strict manner so that the subjects of decentralization and delegation and the subjects of decentralization and delegation can easily implement it smoothly and effectively.
"If we are slow to issue documents guiding the implementation of the law, we will not achieve the goal set by the Party Central Committee, which is to put the newly arranged apparatus into operation, serving the target of 8.0% GDP growth in 2025 and double-digit growth from 2026," Mr. Tuan added.
Agreeing with the provision "The Prime Minister does not decide on issues and work of ministers and heads of ministerial-level agencies" stipulated in the draft law, delegate Le Xuan Than (Khanh Hoa) said that this is consistent with the role and status of managing the national administration.

"Decree 137/2020 still assigns the Prime Minister to decide on fireworks displays at festivals. This means that even very small tasks and matters are still assigned to the Prime Minister. Thus, the Prime Minister no longer has time to do the work of managing the national governance," Mr. Than stated his opinion.
The draft Law on Government Organization (amended) consists of 5 chapters and 32 articles (compared to the current Law, 2 chapters and 18 articles are reduced), and is expected to be considered and approved by the National Assembly at this session.
