No vote of confidence for leaders on medical leave

On the afternoon of May 30, continuing the program of the 5th Session, the National Assembly listened to the Head of the Delegation Work Committee of the National Assembly Standing Committee Nguyen Thi Thanh present the Report on the draft Resolution on taking a vote of confidence, voting for confidence in people holding positions elected or approved by the National Assembly and People's Councils (amended);

Presenting the report, Head of the Delegation Work Committee Nguyen Thi Thanh said that the draft Resolution consists of 22 articles, compared to Resolution No. 85, 2 articles remain the same, 16 articles are amended and supplemented, and 4 new articles are added; there are 7 appendices, including 2 new appendices.

One of the new points in the draft is the amendment and supplement to the subjects of the vote of confidence. Specifically, the position of Secretary General of the National Assembly is added to the list of subjects of the vote of confidence, in order to comply with the Law on Organization of the National Assembly and Regulation No. 96.

In addition, the draft has revised and supplemented cases where a vote of confidence is not taken for people who have announced their retirement, announced their retirement, or were appointed or elected in the year of the vote of confidence.

According to the draft Resolution, a person who is subject to a vote of confidence and is rated "low confidence" by more than half to less than two-thirds of the total number of National Assembly deputies and People's Council deputies must resign. In case of not resigning, the agency or person with the authority to recommend that person for election or approval by the National Assembly or People's Council is responsible for submitting to the National Assembly or People's Council for a vote of confidence at that session or the nearest session.

If a person subject to a vote of confidence is rated "low confidence" by two-thirds or more of the total number of National Assembly deputies or People's Council deputies, the agency or person with the authority to recommend that person for election or approval by the National Assembly or People's Council shall be responsible for submitting to the National Assembly or People's Council for dismissal at that session or the nearest session.

The Draft Resolution also adds provisions on the consequences of taking a vote of confidence and a vote of no confidence for people who hold multiple positions at the same time; the vote of confidence and dismissal will be carried out once for those positions.

Ms. Nguyen Thi Thanh also said that, through summarizing the practice of taking a vote of confidence and the comments of many agencies, the majority of opinions of the National Assembly Standing Committee agreed that it is necessary to add to Clause 5, Article 2 of the draft Resolution the regulation on not taking a vote of confidence for people who are on leave for treatment of serious illnesses with confirmation from a medical facility and have not been in charge of work for 6 months or more according to the decision of a competent agency or individual up to the time of the opening of the session to take a vote of confidence.

Reviewing this content, Chairman of the National Assembly's Law Committee Hoang Thanh Tung said that the addition of the regulation that no vote of confidence is taken for people who are on leave for serious illness treatment with confirmation from a medical facility and have not been in charge of work for 6 months or more according to the decision of a competent agency or individual as in Clause 5, Article 2 of the draft Resolution is based on practical grounds, demonstrates humanity and is consistent with the requirements of taking a vote of confidence at the National Assembly and People's Councils; in addition, there are opinions suggesting that it is necessary to clearly state that the period of not being in charge of work is 6 consecutive months or more to ensure strictness.

In order to have a basis for the National Assembly to consider and decide, some opinions in the Law Committee suggested that the drafting agency should explain more clearly the reason why the draft Resolution does not include a number of positions elected or approved by the National Assembly or People's Councils to be subject to a vote of confidence, such as Judges of the Supreme People's Court, members of the National Defense and Security Council, Deputy Heads of the People's Council, and People's Court Jurors.

Regarding the consequences for those who are subject to a vote of confidence or a vote of no confidence, Mr. Hoang Thanh Tung said that the Law Committee found that the provisions on the consequences for those who are subject to a vote of confidence or a vote of no confidence in the draft Resolution have ensured compliance with the requirements for timely and strict handling of officials with low levels of confidence in the spirit of Regulation No. 96 and Regulation No. 41 of the Politburo on dismissal and resignation of officials.

Therefore, the Law Committee basically agrees with the provisions on consequences for those who are given a vote of confidence and vote of confidence as in the draft Resolution.

In addition, regarding the provisions in Clause 1, Article 12, the Law Committee proposed to revise the direction that in the case where the person subject to the vote of confidence has more than half to less than two-thirds of the total number of delegates rating the person as low confidence and does not resign, the National Assembly Standing Committee shall submit to the National Assembly, the Standing Committee of the People's Council shall submit to the People's Council for a vote of confidence, instead of the provision that "the agency or person with the authority to recommend that person for the National Assembly, People's Council to elect or approve is responsible for submitting to the National Assembly, People's Council to conduct a vote of confidence" as in the draft Resolution to ensure consistency with the provisions on the subject with the authority to submit to the National Assembly, People's Council for a vote of confidence in Article 13 of the draft Resolution and also inherit the corresponding provisions of Resolution No. 85 .
