At the 5th session, the 15th National Assembly passed the Law amending and supplementing a number of provisions of the Law on Exit and Entry of Vietnamese Citizens and the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam (Law No. 23/2023/QH15).
Accordingly, Law No. 23 takes effect from August 15, 2023. Up to now, after more than half a month of taking effect, Law No. 23 has contributed to simplifying and creating a legal basis to promote administrative reform, decentralization, and implementation of administrative procedures in the electronic environment; creating convenience for agencies, organizations, foreigners and people, contributing to promoting the socio-economic development of the country.
One of the new regulations in Law No. 23 is the addition of regulations on the cancellation of the validity of ordinary passports for cases where a passport has been issued but the results have not been received.
Accordingly, after 12 months from the date the competent authority scheduled to return the passport, if the citizen does not receive it and does not notify the competent authority in writing of the reason for not receiving it, the passport-issuing authority will cancel the validity of the passport.
Colonel Nguyen Ba Tuan - Deputy Director of the Immigration Department (Ministry of Public Security) - said: Recently, there has been a situation where citizens requesting a passport do not come to receive the passport when it is time to receive the results, leading to many difficulties in managing passports issued to citizens who come to receive them.
Meanwhile, the passport issuing authority has no basis to process these passports. Therefore, Law No. 23 stipulates the cancellation of passport validity for cases where passports have been issued but the results are not received to ensure the effectiveness of immigration management of Vietnamese citizens.
Providing more information on this matter, Major General Pham Dang Khoa - Director of the Immigration Department - said that currently, receiving passport results is very easy. In addition to receiving them directly at the immigration agency, citizens can register with the post office to receive the results at home.
"People can stay at home and the post office will send the results to their homes when they have them," said Major General Pham Dang Khoa.
However, Mr. Khoa also said that in reality, there have been cases where people have provided incorrect or unclear addresses, leading to the post office coming many times but not being able to meet the recipient. Therefore, the citizen's passport will be returned to the passport issuing agency.
Major General Pham Dang Khoa said that according to the provisions of Law No. 23, after 12 months if the citizen does not receive the results and does not respond, the immigration management agency will have the right to cancel the passport results. After that period, if the citizen needs the passport, he/she will continue to apply for a new one.
