The Ministry of Public Security has just announced a draft circular detailing a number of articles and measures to implement the Law on Identification. This law takes effect from July 1.

What is residence?
The regulation of residence instead of permanent residence shown on the ID card is considered to ensure more benefits for the people. Because the residence has a much wider scope than the permanent residence.
In the draft, the Ministry of Public Security clearly stated that there are three cases of residence. First, the place of residence is the permanent residence of the person granted the card in the National Population Database.
Second, if the person requesting an identity card does not have a permanent residence but has a temporary residence, the place of residence is the temporary residence of the person granted the card in the National Population Database.
Third, if the person requesting the issuance of an identity card does not have a permanent or temporary residence due to not meeting the conditions for permanent or temporary residence registration, the place of residence is the current residence of the person being issued the card which has been updated in the National Population Database.
In case the person requesting the issuance of an identity card does not have information about their place of residence in the National Population Database, the identity management agency is responsible for guiding the citizen to carry out the procedures for permanent residence registration, temporary residence registration or declaration of information about residence.
Under the new regulations, the permanent residence information on the card will be changed to residence.
What to do if there is no information about hometown or place of birth?
Still in the draft circular, the Ministry of Public Security stipulates how to handle some cases where there is no or incomplete information on the ID card.
In case information on ethnicity or religion is not available or has been collected but citizens request to update or adjust, the identity management agency is responsible for updating and adjusting according to regulations.
The Ministry of Public Security notes that updated and adjusted ethnic and religious information must be on the list of ethnic and religious groups issued or recognized by competent authorities.
In case information on place of birth, place of birth registration, and hometown is not available or cannot be fully collected at commune, district, and provincial levels, the identity management agency is responsible for requesting people to present documents issued by competent authorities showing the above information for updating and adjustment in the National Population Database and identity database.
In case the papers and documents provided by the people do not show or do not fully show the administrative place names at the commune, district, or provincial levels, the identity management agency shall request the people to provide information and have a written commitment to the information provided.
At the same time, the identity management agency is responsible for coordinating with the civil status management agency to check and verify before updating and adjusting to ensure accuracy and consistency.
Issue mobile ID cards when needed
Another content proposed by the Ministry of Public Security in the draft is the organization of receiving applications for granting, exchanging, and re-granting mobile ID cards.
Accordingly, the identity management agency shall issue, change, and reissue identity cards at agencies and organizations when there is a written request and the identity management agency has sufficient conditions in terms of means, technical equipment, and human resources to perform.
The identification management agency shall issue identification cards at the citizen's place of residence in cases where the elderly, sick, ill, or disabled are unable to travel and the identification management agency has sufficient means, technical equipment, and human resources to carry out the procedures.
