Strictly handle cases that are both unreasonable and illegal.
Delegate Tran Van Sau (Dong Thap Delegation) said that the Covid-19 pandemic, besides the victories, has left us with many things to discuss, to think about and, more importantly, to change.
Vice Chairman of the National Assembly Nguyen Khac Dinh chaired the meeting on the afternoon of May 29 on mobilizing, managing and using resources to prevent and fight the Covid-19 pandemic. |
From the beginning, we determined to fight the epidemic like fighting the enemy. The spirit was to be urgent, mobilize all resources, use all measures, accept sacrifices to win.
In the fight against the pandemic, there are so many things to do, so many situations that need to be decided without precedent. The rational and the legal are intertwined, and there are things that contradict each other, so after the pandemic, the social mood has become very heavy.
How to handle unreasonable and illegal matters is a matter of great concern to voters. Delegates gave examples of the Viet A case, the rescue flight that brought Vietnamese citizens from abroad back to the country for quarantine, etc. These are cases that are of great concern to the people.
"The positive effect is that we have resolutely and decisively dealt with lawbreakers who have long been considered difficult to reach, and this has had a strong influence, strengthening the Party's trust among the people," said delegate Tran Van Sau.

However, delegate Tran Van Sau also emphasized that according to public opinion, there are still sorrows. Sorrows because of human love, comradeship, and more painfully, the fate of compatriots, the life of the nation and the image of the nation. Therefore, it is necessary to handle these cases seriously and urgently to stabilize public opinion.
How to deal with something that is reasonable but illegal?
Besides, delegate Tran Van Sau raised the issue that after successfully fighting the Covid-19 pandemic, inspection, examination and auditing work showed that there were too many things that were reasonable at that time but illegal at this time.
“How do we deal with this issue? I feel very sympathetic because in the stressful anti-epidemic campaign, officials act with a sense of responsibility and professional conscience, and do not have time to study all the decrees and circulars... and sometimes these documents cannot be applied at that time, so we really need to share and handle them better,” said delegate Tran Van Sau.
National Assembly Chairman Vuong Dinh Hue chaired the meeting. |
According to delegate Tran Van Sau, in the past, every time a war ended, the first thing our Party did was to review who was still alive and who was dead. Those who died were considered, and if they met the requirements, they were recognized as martyrs. Those who were still alive were recognized for their contributions.
“If we fight the epidemic like we fight the enemy, we have not done a good job. I suggest that the National Assembly pay more attention to this issue,” delegate Tran Van Sau expressed his concern.
Delegate Tran Van Sau particularly emphasized that there are many examples in epidemic prevention and control where regulations are unreasonable if applied to a specific case. Following unreasonable things will not achieve the goal, even if it is a legitimate goal. But doing the opposite risks facing responsibility for intentional violations.

After the pandemic, the disease of fear of responsibility, withdrawal, passivity, caution, and reluctance to make decisions has appeared more and more frequently and become more severe. This disease is spreading from the medical industry to other professions. This is an issue that needs to be paid attention to and considered from many perspectives. "If the law is clear, strict, and reasonable, that is, reasonable and legal go together, not applying it is irresponsible. This problem needs to be eliminated immediately," said delegate Tran Van Sau.
However, according to delegate Tran Van Sau, it must be acknowledged that there are reasons why officials and civil servants do not dare to do it because they do not know how to do it properly. Legal documents still have unclear, loopholes, and contradictions. When asking superiors, they get a very general answer: Just follow the provisions of the law.
There are cases where the enforcer understands the law and handles the work in one way, but the person with the authority to inspect and check understands the law and evaluates the work in another way, then the enforcer will definitely get into trouble.
Therefore, in addition to continuing to improve the legal system and creating a legal corridor to encourage people to work confidently, delegate Tran Van Sau suggested that the National Assembly needs to have a mechanism for those with authority to evaluate the behavior of others and apply the law to judge, making what is truly legal and reasonable.
