Hai Duong handles 424 illegal constructions on forest land

On the afternoon of August 15, comrade Luu Van Ban, member of the Provincial Party Standing Committee, Permanent Vice Chairman of the Hai Duong Provincial People's Committee chaired the August meeting of the Provincial People's Committee (5th time) to review and resolve the contents and submissions reported by a number of departments, branches and localities.

Concluding on the content of handling illegal construction works on forest land, Mr. Luu Van Ban, Standing Vice Chairman of the Provincial People's Committee, requested the advisory agency and local authorities to assess the number of works used for housing purposes. From there, classify violations by period and land type to propose handling options. The People's Committees of Chi Linh City and Kinh Mon Town develop a plan with specific handling options and report to the Provincial People's Committee before August 20. The Departments of Agriculture and Rural Development, Natural Resources and Environment, and Construction coordinate with the two localities to guide the handling of illegal housing works. In the handling process, it is necessary to base on legal regulations and the actual situation, not to be too mechanical or rigid. The handling of illegal housing works must be completed in 2024 and ensure that no new violations arise.

The Provincial People's Committee agreed on the plan to hand over the area of ​​fruit tree land managed by the Forest Management Board to the Chi Linh City People's Committee for management. Vice Chairman of the Provincial People's Committee Luu Van Ban requested that the handover must be public, transparent, and seek the opinions of the people.

According to the Department of Agriculture and Rural Development, the total number of constructions violating the law on forest land and land of agricultural and forestry origin in the province is 424 points. Including 327 houses, 74 livestock barns, 23 temples. Of which, 84 constructions violated the law on forest land and 340 constructions violated the law on land for growing fruit trees of agricultural and forestry origin.

The Department of Agriculture and Rural Development proposed a plan to handle violations in accordance with the regulations at the time of the violation. Violations include houses on forestry land before January 1, 2019 with an area not exceeding 200 m2 for the purpose of taking care of contracted forests, with a written agreement with the People's Committee at the commune level, requiring the current status to be maintained, without expansion or repair.

For houses with an area of ​​more than 200 m2 , with an agreement with the local authorities, the excess area must be demolished.

Housing projects without agreement with the People's Committee at the commune level, mobilizing households to voluntarily dismantle, if not implemented, the local government will resolutely handle the enforcement.

For temples, tombs, and livestock barns, mobilize households to voluntarily dismantle and relocate to planned locations. Violations from January 1, 2019 to present must be resolutely handled.

Violations of temporary camps on fruit-growing land of agricultural and forestry origin before February 15, 2017 will be temporarily maintained in their current state, while permanent houses will be resolutely handled. For constructions built after February 15, 2017, local authorities will coordinate to completely handle violations and restore the current state.

The Department of Agriculture and Rural Development also proposed to hand over more than 526 hectares of land for growing perennial fruit trees, ponds, and non-agricultural land of agricultural and forestry origin to the People's Committee of Chi Linh City for management.

The August meeting of the Provincial People's Committee (5th time) also discussed the submission to the Provincial People's Council for a decision on the policy of converting forest use to other purposes. Progress and results in the first 6 months of 2024 of the implementation of Resolution No. 36-NQ/TU dated December 29, 2023 of the Provincial Party Standing Committee on strengthening leadership and direction in the management of activities of riverside wharves, yards, and intra-field canals in the province. Submission on adjusting the content of Appendix I issued with Decision No. 3118/QD-UBND dated December 22, 2023 of the Provincial People's Committee on promulgating the list of projects attracting investment, limiting investment attraction and not attracting investment in Hai Duong province in the period of 2024-2030. Results of reviewing the project to build a railway feeder for the Hanoi - Hai Phong railway (Kim Thanh). Results of inspection and review of all investment and construction procedures and processes, proposed solutions for the construction of 2 Covid-19 epidemic prevention projects at the Hai Duong Center for Disease Control and the Provincial Hospital for Tropical Diseases. Plan to implement 9 established industrial clusters associated with the service road and the North-South axis road (Ninh Giang). Proposal not to convert the tunnel brick factory investment project into a new residential area of ​​Ha Hai Construction Materials Investment and Production Joint Stock Company.
