Kinhtedothi - On December 17, the Ministry of Justice held a national conference to deploy judicial work in 2025. Deputy Prime Minister Le Thanh Long attended and gave a speech at the conference.

Many laws must be amended to serve the organization and streamlining of the apparatus.

At the Conference, Deputy Minister of Justice Nguyen Khanh Ngoc thoroughly grasped the conclusion of General Secretary To Lam at the working session with the Party Committee of the Ministry of Justice, on the occasion of Vietnam Law Day, November 9. Accordingly, the General Secretary pointed out the shortcomings and limitations in the work of perfecting institutions. These are some major policies and orientations of the Party that have not been institutionalized promptly and fully, or have been institutionalized but their feasibility is not high.

The quality of law making and improvement has not met practical requirements. Some newly issued laws have had to be amended. Many regulations are still overlapping, unclear, cumbersome, hindering implementation, causing loss and waste of resources; not creating a truly favorable environment to promote innovation and unleash resources among the people. Law and policy enforcement is still a weak link; policies have not been identified and responded to promptly, especially in the face of new issues. Notably, signs of influence and "group interests" in the law making process are "worrisome, causing damage, even creating a turning point for development".

According to Deputy Minister of Justice Nguyen Khanh Ngoc, during a meeting with the Party Committee of the Ministry of Justice, General Secretary To Lam requested strong innovation in the law-making process with three guarantees: ensuring democracy, transparency, timeliness, feasibility, efficiency, ease of application in practice, saving time and costs, improving "productivity and quality" of law-making; ensuring substantive policy impact assessment; ensuring the implementation of a mechanism for receiving and explaining comments from affected subjects when designing policies and laws, not pushing difficulties onto people and businesses...

Speaking at the conference, Chairman of the National Assembly's Law Committee Hoang Thanh Tung said that amending the Law on Promulgation of Legal Documents is also an important task of the Law Committee in the coming time and requires close coordination with the Ministry of Justice - the Government's gatekeeper on law-making. In response to very new requirements, the Standing Committee of the Law Committee is being assigned by the National Assembly's leadership to advise and prepare to organize a legal forum on the topic of innovative thinking in law-making. This is also a common task that the Ministry of Justice is prioritizing.

According to the Chairman of the National Assembly's Law Committee, regarding the immediate task, the two agencies are coordinating and discussing to advise on legal solutions to serve the revolution of streamlining the apparatus that is being vigorously implemented.

Initially, the Ministry of Justice has identified more than 150 laws specifically naming ministries; that is, when the operations end and the ministries are merged with the expected reduction of 5 ministries, 5 agencies under the Government, and 12/13 general departments and equivalents, the names of these agencies in the laws will have to be legally handled.

“There is an opinion that one law can be used to amend many laws, but we find it difficult to ensure this, so we are leaning towards the immediate option of submitting a resolution to the National Assembly to handle the names of the ministries (after the merger). The laws will have time to be reviewed and handled carefully, strictly, and scientifically,” informed Hoang Thanh Tung, Chairman of the National Assembly’s Law Committee.

Further improve the quality and effectiveness of judicial work

Concluding the conference, emphasizing the tasks for the judiciary in 2025, Deputy Prime Minister Le Thanh Long requested to thoroughly grasp and promote the implementation of the General Secretary's instructions during the working session with the Party Committee of the Ministry of Justice, in which, he noted the need to innovate the thinking of law-making, resolutely abandoning the thinking of "if you can't manage, then ban". Law-making work must ensure feasibility, efficiency, low compliance costs, reach people and businesses, improve productivity and quality; strengthen decentralization, delegation of power, and reform administrative procedures.

In 2025, implementing the request of General Secretary To Lam on transforming the thinking of law-making, the Ministry of Justice will develop and submit to the Politburo for promulgation a Directive on "Innovation in law-making and enforcement to meet the requirements of national development in the new era". The Deputy Prime Minister noted that the Ministry of Justice must do this work well, in which it is necessary to pay attention to collecting opinions from all levels, agencies, ministries and branches. Proactively review, propose timely amendments and supplements to legal documents related to the arrangement and streamlining of the apparatus so that the administrative system is not interrupted.

Along with that, the Deputy Prime Minister suggested that the Ministry of Justice pay more attention to digital transformation, considering this a prerequisite for the good and full implementation of the functions and tasks of the Ministry and the judiciary. The Ministry of Justice and the judiciary need to seriously and urgently summarize the implementation of Resolution No. 18-NQ/TW, propose innovation, arrangement, completion of functions, tasks, powers and organize a streamlined apparatus, operate effectively and efficiently, with the orientation of reducing at least 15-20% of internal organizational units. Do not arrange mechanically, do not interrupt the performance of tasks.

The Ministry of Justice and the judicial sector shall promote their roles and continue to focus resources and intelligence to help the Government and People's Committees at all levels properly handle legal issues in the process of economic development and international integration, including the prevention and resolution of international investment disputes.

The Deputy Prime Minister also hopes that central and local ministries, branches and sectors will pay attention, share and closely coordinate with the Ministry of Justice and the judicial sector, ensuring resources and other necessary conditions to further improve the quality and effectiveness of judicial work.
