In recent years, the Provincial Party Committee, the Provincial People's Committee and all levels, sectors and localities have paid attention to directing the implementation of construction order management (TTXD), gradually bringing this work into order; many projects and works invested in and constructed in accordance with regulations have contributed to the socio-economic development of the province; the rate of violating works out of the total number of works inspected in 2023 decreased compared to 2022 from 4.08% to 2.65%.

Resolutely handle violations

In addition to issuing directive documents, the town has stepped up propaganda work, raising people's awareness in implementing regulations on construction order; assigned the urban management department to open a monitoring book to receive construction commencement notification files for projects classified according to regulations; at the same time, directed the town's urban rules inspection team to set up mailboxes in communes and wards to receive information reflecting violations of construction order from people. In addition, the town has strengthened inspection of construction order after licensing; in the period of 2021-2024, the town has inspected, detected and handled 12 violations, including 3 cases of unlicensed construction, 8 cases of unlicensed construction, 1 case of a residential area project where the investor allowed people to build houses that were not in accordance with the planning. Like Bim Son town, from 2021 to March 2023, in the field of planning and land use management, Thanh Hoa City Construction Department issued 138 decisions to sanction administrative violations, imposing fines of VND 5,556,500,000, including 60 cases of land use for the wrong purpose, 11 cases of land encroachment, 10 cases of construction not in accordance with approved planning, 3 cases of construction not in accordance with approved design, 10 cases of construction not in accordance with the content of the granted license, 19 cases of construction without permission, 9 cases of construction without permission, not in accordance with approved design, appraisal... Besides, Thanh Hoa City People's Committee also issued 13 decisions to force the implementation of remedial measures, 11 decisions to enforce the implementation of remedial measures...

Minimize violations

From the determination to handle violations of construction regulations by localities, in recent years, the management of construction regulations, planning, and land use in the province has gradually been implemented in accordance with regulations, violations such as illegal construction and illegal construction have been significantly reduced. According to the assessment data of the Department of Construction, in 2023, the rate of violating construction works out of the total number of inspected construction works decreased compared to 2022 from 4.08% to 2.65%. In 2023 alone, localities inspected 4,229 construction works (4,061 construction works in 2022), through inspections, 126 violations were detected (195 cases in 2022), 115 decisions on administrative sanctions (VPHC) were issued with a total amount of 5,428,551,000 VND.

In particular, some districts have made positive changes in the management of construction regulations, such as: Cam Thuy district inspected 50 works; Dong Son district inspected 163 works, sanctioned 5 cases, and imposed administrative fines of 320,000,000 VND.

However, according to the assessment of the Department of Construction, the management of construction works in some localities still has limitations, inspection work is not regular and continuous; the situation of construction without permits, without permits, and against the approved design still occurs in some places and some fields, especially the construction of individual houses on urban planning sites that do not comply with detailed planning and approved urban design; in some places, inspections detect violations but there are no thorough handling measures. The reason is that the awareness of compliance with construction laws of some organizations and individuals participating in construction activities is not good. In particular, some subjects deliberately violate, organize construction works on holidays, holidays and outside of working hours, in a short time, causing many difficulties in monitoring and supervising to prevent violations from arising. The situation where investors let people build their own houses on the planned land of projects that won the auction for land use rights, which according to regulations must be built in rough housing, has been limited but still occurs in some projects. Investors lack responsibility in supervising and handling, leading to people building their own houses according to their personal needs, which do not comply with approved urban designs, such as: building lots, wrong facade architecture, expanding and building lots...

To overcome the above shortcomings and limitations, the Department of Construction has requested the Provincial People's Committee to direct localities to seriously review responsibilities and immediately overcome shortcomings and limitations in management, especially in granting construction permits to households in the planning areas of new rural residential areas, for localities that have granted very few construction permits and have not performed well in construction management; People's Committees of districts, towns and cities must closely direct departments, offices and functional units to resolutely and effectively implement the directives and management documents of the Provincial People's Committee and the Chairman of the Provincial People's Committee on planning management and construction management in the province. Direct regular or surprise inspections of construction works to promptly detect, apply timely preventive measures and resolutely handle violations. In cases of delay or non-compliance with administrative measures, there must be a plan for enforcement according to regulations. Construction must not be allowed to continue when violations are discovered.
