Progress of the mediation session of the property dispute of the late actor Duc Tien

On the morning of March 27, the People's Court of Ho Chi Minh City opened a mediation session on the inheritance dispute of the late actor Duc Tien.

The Ho Chi Minh City People's Court (HCMC People's Court) opened a mediation session for the inheritance dispute of Mr. Hoang Duc Tien (late actor Duc Tien) on the morning of March 27. In this case, the plaintiff is Ms. NBP (wife of the late actor Duc Tien, currently living in the US) and the defendant is Ms. NNA (mother of the late actor Duc Tien). The person with related rights and obligations is MH (daughter of the late actor) with the legal representative being Ms. BP (biological mother).

The content of the conciliation session includes: resolving the plaintiff's claim, the defendant's counterclaim and disputed issues between the parties.

According to Thanh Nien sources, in the mediation session on the morning of March 27, Ms. BP was in the US so she authorized a legal representative but this person was absent, only her lawyer attended. Ms. NA did not come to court in person but sent a lawyer to represent her under authorization to participate in the proceedings and a lawyer to protect her legal rights and interests attended.

Due to the absence of the litigant, the court did not hold a conciliation session as scheduled. The court only recorded the opinions of the parties. Accordingly, the plaintiff, Ms. BP, maintained the original lawsuit request. The defendant, NA, maintained the original counterclaim request, and added a request for the court to determine that the land plot in Long An is the private property of the late actor Duc Tien; and to adjust the inheritance division ratio.

Previously, Ms. NBP filed a lawsuit, requesting the court to recognize her as receiving the real estate located at 26/4A, Street 24, Ward 7, Linh Dong Ward, Thu Duc City (HCMC) and land plot No. 1841, map sheet No. 6, located in Duc Hoa District, Long An Province. Ms. NNA and baby MH each received a portion of Mr. Hoang Duc Tien's inheritance with an amount of more than 666 million VND.

Ms. NNA is currently living at house 26/4A, Street 24, Ward 7, Linh Dong Ward, Thu Duc City. After the Ho Chi Minh City People's Court accepted the lawsuit, Ms. NNA filed a counterclaim. According to the counterclaim, Ms. NA requested the court not to recognize the will of the late actor Duc Tien made on August 9, 2023 in the US, because this will was notarized in the US and is not in accordance with Vietnamese law.

The late actor's mother also requested the following contents: to determine the real estate in Linh Dong ward, Thu Duc city, Ho Chi Minh city as the joint property of Ms. NA and the late actor, Ms. NA will receive 50% of the value of the house; to determine the legacy of the late actor Duc Tien, including: 50% of the value of the real estate in Linh Dong ward (in the joint property with Ms. NA), 50% of the value of land plot No. 1841 (in the joint property with Ms. BP); to divide 50% of the value of land plot No. 1841 equally among the 3 first-line heirs of Mr. Tien, Ms. NA, Ms. BP, and baby MH. In addition, the effort to manage and embellish the inheritance for Ms. NA is 20% of the 50% value of the real estate in Linh Dong ward of the late actor. The remaining 80% is divided equally among the first-line heirs of the late actor Duc Tien, namely Mrs. NA, Mrs. BP, and baby MH. Mrs. NA will receive the real estate and pay the two co-heirs of Mr. Tien according to the above ratio.
