Recently, the Natural Resources and Environment Newspaper published an article in which Hoa Binh “named” a series of projects “involved” in land and construction violations . The article reflects the information that the Hoa Binh Provincial Inspectorate has just issued Inspection Conclusion No. 27/KL-TTr concluding the compliance with legal regulations on land, finance, and construction to implement projects that the State has allocated land, leased land, and recognized land use rights for organizations and enterprises in Mai Chau district in the period 2011-2021. During the inspection process, the Hoa Binh Provincial Inspectorate discovered many enterprises with violations in the fields of land, construction, and investment.
On that basis, the Inspectorate of Hoa Binh province requested the People's Committee of Hoa Binh province to direct the Department of Construction to preside over and coordinate with the Department of Natural Resources and Environment, the People's Committee of Mai Chau district, the People's Committee of Mai Chau town, the People's Committees of Bao La and Na Phon communes to inspect constructions that are not in accordance with the permits of competent authorities or do not follow the construction procedures as prescribed to handle according to the law on construction with 05 projects: Mai Chau Ecologdge Eco-tourism Resort Project (Na Phon commune, Mai Chau district); Bamboo Panel Factory Project invested by BWG Mai Chau Joint Stock Company (Chieng Chau commune, Mai Chau district); Hop Thuy Trade and Service Complex Project invested by Hop Thuy Trade and Service Company Limited (in Mai Chau town, Mai Chau district); AVANA Mai Chau Resort Project (in Pieng Ve commune, Mai Chau district); Project on Growing and Preliminary Processing of Clean Medicinal Herbs in the Direction of Commodity Production (Thung Khe Commune, Mai Chau District).
The Inspectorate of Hoa Binh province also requested the Department of Construction of the province to inspect the construction permit granted by the People's Committee of Mai Chau district for the Ngoc Bach Conference Center project (invested by Ngoc Bach One Member Co., Ltd.) to handle it according to the provisions of the law on construction.
In addition, the Inspectorate of Hoa Binh province requested the People's Committee of Hoa Binh province to review the responsibility of the collective and individuals towards the Department of Natural Resources and Environment of the province in granting 02 land use right certificates to Lan Tran Environmental Technology Application and Investment Company Limited (now Mai Chau Construction Joint Stock Company) located in the planning of 3 types of forests, leading to difficulties in implementing the project of Growing and processing clean medicinal herbs in the direction of producing goods for investors;
Review the responsibility of the collective and individuals towards the Department of Planning and Investment of the province in allowing the investor, Hai Dang Tourism Group Joint Stock Company, to implement the project on the aquaculture land area with a total leased land area of 13,963.5 m2 in Bo Bau hamlet, Tan Son commune, Mai Chau district, the land lease term is until February 4, 2063 (land lease for raising zebrafish) but has not been implemented. On February 21, 2020, this Department still advised the People's Committee of Hoa Binh province to approve Hai Dang Tourism Group Joint Stock Company to invest in the Mai Chau Home Rest Stop project in Bo Bau hamlet, Dong Tan commune, Mai Chau district;
Review the responsibility of the collective and individuals of Mai Chau District People's Committee in granting the wrong license for the Ngoc Bach Conference Center project implemented by Ngoc Bach One Member Co., Ltd. and allowing Mai Chau Trading One Member Co., Ltd. to illegally construct (pouring concrete to cover the drainage surface, making the drainage system of the road project ineffective but not yet remedied);
Organize a review of the responsibility of collectives and individuals towards the People's Committees of the communes: Na Phon, Pieng Ve, Chieng Chau, Mai Chau town in allowing investors to build without proper construction permits.
It is known that in addition to enterprises with violations in the field of investment and construction, the Inspectorate of Hoa Binh province also pointed out a number of land violations of specific units and enterprises such as:
The Tuan Quynh Son La petrol station and service complex project has not yet invested in construction for the additional land area of 2,000 m2 ; the unit has not provided records and documents related to determining the forest area on production forest land and records of replacement forest planting with a total area of 5,000 m2 of allocated land;
The Mai Chau District Tax Department's office building project has been put into use since 2019, but the Provincial Tax Department has not yet paid the rice land protection and development fund for the additional rice land area of 1,694.6 m2 . According to the unit's report, because the investment source for expanding the Mai Chau District Tax Department's office building has not been provided with additional funding by the General Department of Taxation, the unit does not have the source to pay. When the funding is provided, the unit will pay the rice land protection and development fund according to regulations.
