Former Director of Thu Duc City Hospital apologizes to people before the court announces verdict

On the afternoon of November 30, the trial of defendants Nguyen Minh Quan (former Director of Thu Duc City Hospital) and Nguyen Van Loi (Director of Nguyen Tam Production Service Trading Company Limited) for the crimes of Embezzlement of Property and Money Laundering continued.

In the indictment, the representative of the People's Procuracy proposed that the People's Court sentence defendant Nguyen Minh Quan to 21-23 years in prison and Nguyen Van Loi to 16-18 years in prison for the crimes of Embezzlement of property and Money laundering.

Defendant Nguyen Tran Ngoc Diem (Quan's wife) was recommended to be sentenced to 2 years and 6 months to 3 years and 6 months in prison for Money Laundering. The remaining defendants in the case were recommended to be sentenced to 2 years and 6 months to 4 years and 6 months in prison for Violating bidding regulations causing serious consequences.

Mr. Quan's defense attorney argued that his client did not commit the crime of embezzlement as alleged in the indictment and the indictment. The attorney presented many opinions that the behavior of the former Director of Thu Duc City Hospital violated the crime of violating bidding regulations causing serious consequences.

Defense attorneys for the remaining defendants presented many mitigating circumstances and asked the panel of judges to consider them when sentencing.

In response to the views of the lawyers and defendants, the representative of the People's Procuracy said that the indictment prosecuted the right person for the right crime, and when convicting, it fully considered mitigating circumstances.

Mr. Quan's defense attorney argued that his client was not the subject of the crime of embezzlement. In response to this view, the prosecutor said that the defendant Quan was a person with authority, operating "backyard" companies to carry out procedures to inflate the price of medical equipment and then bring it to the hospital.

Participating in bidding was Mr. Quan's trick to withdraw money from Thu Duc City Hospital and appropriate assets. From that, the representative of the People's Procuracy determined that the defendant Quan's actions had sufficient elements to constitute the crime of embezzlement of assets.

Having the last word, defendant Quan asked the panel of judges to be lenient and reduce his sentence. Mr. Quan said that during the Covid-19 pandemic, he had to take charge of 7 field hospitals (Thu Duc City, Can Gio) by himself.

"The defendant currently has an elderly mother with poor health. His parents sent him to study to become a doctor. I hope the court will consider allowing him to return soon to continue contributing to the medical profession and teaching work," defendant Quan said.

Finally, defendant Quan apologized to the people of Thu Duc City and the staff of Thu Duc City Hospital.

In turn, defendant Nguyen Tran Ngoc Diem asked the court to consider leniency under the law. At the same time, this woman asked the panel of judges to create conditions for her to sell her assets to remedy the consequences of the case.

The remaining defendants in the case expressed remorse and asked the court to consider reducing their sentences.

Tomorrow morning (December 1), the People's Court will issue a verdict on the case.

The indictment determined that the defendant Quan took advantage of his position as director and head of the hospital to direct and pressure his subordinates and members of the bidding committees to sign to legalize bidding documents, "collusion, fraud in bidding, and failure to ensure transparency in bidding activities".

The investigation results determined that from 2016 to 2020, a group of 4 companies managed by Loi participated in bidding and were the default winners of 27/28 bidding packages at Thu Duc City Hospital, with a total value of more than 345.2 billion VND.

Quan directed Loi to transfer or withdraw cash to him or Nguyen Tran Ngoc Diem.
