On November 30, receiving comments from National Assembly deputies on the Draft Law on Digital Technology Industry, Minister of Information and Communications Nguyen Manh Hung said that digital technology is the next development of information technology but is revolutionary. Digital technology gives birth to digital transformation. Digital technology is a new productive force, truly opening a new era, the digital era for the development of humanity. If Vietnam wants to become a developed socialist country with high income, we must be in the leading group in digital technology and digital technology industry. If the National Assembly passes this Law in the next session, Vietnam will be the first group of countries to have a separate law on digital technology industry.

The digital technology industry is a very dynamic, very large and very important technical economic sector of the country. Perhaps the most important thing is to clarify the concept of digital technology, especially how digital technology is different from information technology. To distinguish between information technology and digital technology is mainly to distinguish between their processing objects, which are information and data. Information technology processes information, digital technology processes data. Information technology is the digitization of information and processing of information, for example, digitizing text and then processing it on a computer.

Digital technology generates data and processes data. Data is unstructured, meaningless, raw, unprocessed resources. Data is infinite, much larger than information. Data is a new resource, a new means of production, a new input for production, like land in the real world. In the process of development, humans consume and deplete resources, and today, human development creates a new resource, data, and solves the global problem of resource depletion.

Digital technology processes data, creates new values, and creates development for the country. In terms of specific technologies, digital technologies include previous generation information technologies, new generation digital technologies such as the Internet of Things, big data, cloud computing, artificial intelligence, blockchain, virtual reality and other digital technologies, such as quantum computing, which are emerging due to their ability to process much larger data.

The first law to use AI to assist

According to Minister of Information and Communications Nguyen Manh Hung, the 2006 Law on Information Technology has 3 main parts: the network information security part has been separated into the 2015 Law on Network Information Security; the development part, mainly the information technology industry, is being separated into the Law on Digital Technology Industry, expected to be passed by the National Assembly in 2025; the application part, mainly about e-Government, is expected to be separated into the Law on Digital Government by the National Assembly, and then the Law on Information Technology may cease to exist. The separation into 3 separate laws is to create a strong development space for all 3 of these very important fields. Other countries in the world also approach this way.

Implementing the direction of General Secretary To Lam and National Assembly Chairman Tran Thanh Man on innovation in legislative work, the law stipulates general principles on management and development for new issues that are in the process of being developed, ensuring that management must keep up with and create development. Then, the Government is assigned to provide detailed regulations to ensure flexibility. The Law on Digital Technology Industry has taken this approach to handle digital assets and artificial intelligence.

The Law on Digital Technology Industry also devotes a separate chapter to the semiconductor industry. In September 2024, the Prime Minister issued a national strategy on the semiconductor industry, considering semiconductor chips as a core technology. The draft law has stipulated policies to support the development and ensure national security for this strategic industry. Many of the best policies have been included in the law to support this strategic technology.

Minister of Information and Communications Nguyen Manh Hung said that, taking into account the opinions of National Assembly deputies, the drafting agency will invest more in green digital technology industry content because digital technology will be the field that consumes the most energy and electronic waste. The digital technology industry will not only be green but also self-reliant and safe. Therefore, the drafting agency will invest more in self-reliant, safe and green content.

“Regarding synchronization with issued and drafted laws, the Draft Law on Digital Technology Industry is the first law that uses AI to support the detection of conflicts and overlaps in legal documents,” informed Minister of Information and Communications Nguyen Manh Hung.

Support businesses to develop digital technology

Concluding the session, Vice Chairman of the National Assembly Nguyen Duc Hai said that through discussion, delegates agreed on the necessity of promulgating the Law on Digital Technology Industry to overcome the shortcomings of current laws, implement the Party's policy on digital technology, apply digital technology to socio-economic activities, contribute to forming and developing digital production methods, fundamentally changing the way the state and citizens interact, gradually shifting from assembly and processing to creative design, integrated production, mastering core digital technology, contributing to promoting national digital transformation and developing the digital economy and society.

Delegates gave opinions and discussed the scope of regulation, interpretation of terms, digital technology development policies, classification of digital assets, digital currencies, digital data, human resources in digital technology, digital technology zones, development of digital technology enterprises, controlled testing mechanisms and artificial intelligence semiconductor industry.

Delegates raised ideas about protecting privacy in the digital field, the responsibility of enterprises in sustainable development of digital technology, prioritizing the development of green technology and safe energy saving, supporting enterprises in developing digital technology, the responsibility of transferring to foreign enterprises in this field; requiring transparency and risk control when developing digital technology and artificial intelligence.

Delegates also proposed to review to ensure consistency in the legal system, and to provide many opinions on specific provisions in the Draft Law. These are responsible opinions that need to be carefully studied to absorb, explain, and perfect the Draft Law.

"The National Assembly Standing Committee will direct the verification agency to closely coordinate with the drafting agency and relevant agencies to study opinions to absorb and complete the Draft Law for submission to the National Assembly for consideration and decision," emphasized Vice Chairman of the National Assembly Nguyen Duc Hai.
