According to Decision No. 528/QD-BCT on the regulations on functions, tasks, powers and organizational structure of the Department of Organization and Personnel signed by the Minister of Industry and Trade on February 28, the Department of Organization and Personnel is an organization under the Ministry of Industry and Trade, performing the function of advising and assisting the Minister of Industry and Trade in state management of organizational apparatus, payroll; personnel; internal political protection; training and fostering of cadres, civil servants, public employees and human resource development of the Industry and Trade sector; labor and salary policies for cadres, civil servants, public employees and emulation and reward work in the Industry and Trade sector according to the provisions of law.

The Department of Personnel Organization has the duty and power to submit to the Minister for submission to the competent authority for decision on promulgation or amendment and supplementation of the Regulations on functions, duties, powers and organizational structure of the Ministry; establish, upgrade, reorganize, dissolve Departments, Divisions, Ministry Inspectorate, Ministry Office and equivalent, public service units and other organizations according to regulations; issue a list of public service units under the Ministry; regulate the decentralization of state management of industry and trade between the Central and local levels.
At the same time, synthesize and submit to the Minister for promulgation or submit to competent authorities for promulgation and approval: The overall project on the organizational structure of the Ministry of Industry and Trade; stipulate the functions, tasks, powers and organizational structure of the Departments, Bureaus, Inspectorate of the Ministry, Office of the Ministry and equivalent, public service units and other organizations according to the provisions of law; assign and decentralize to organizations under the Ministry; general circulars on the functions, tasks, powers and organizational structure of specialized agencies under the Industry and Trade sector of the People's Committees at all levels according to regulations; rank public service and career organizations under the Ministry; payroll, number of job positions of administrative agencies under the Ministry according to regulations, list of job positions, structure of civil servants by professional titles and number of employees annually for the Departments and equivalent, public service units under the Ministry according to regulations.
Regarding the management of cadres, civil servants and public employees, the Department of Organization and Personnel also has the duty and authority to propose to the Prime Minister to decide on the appointment, reappointment, transfer, rotation, dismissal, discipline, termination and retirement of Deputy Ministers and equivalents, and to decide on salaries, bonuses, allowances and other policies for this position in accordance with the provisions of law.
