Correcting violations in the fields of land, environment and water resources

(QBĐT) - Through the inspection of compliance with laws on land, environment, and water resources at a number of units in the province, the Inspectorate of the Department of Natural Resources and Environment (now the Inspectorate of the Department of Agriculture and Environment) has discovered many violations and has requested the violating units to promptly rectify and overcome them.

The Department of Natural Resources and Environment (DONRE) Inspectorate has conducted inspections at 4 projects of 3 units, including: CP Vietnam Livestock Joint Stock Company (including: Vietnam High-Tech Aquatic Products Company Limited - Branch 1 and Vietnam High-Tech Aquatic Products Company Limited - Branch 2 in Quang Binh, both operating in Le Thuy district); Nam Sao Aquatic Products Joint Stock Company (operating in Bo Trach district) and Duc Toan Company Limited (Duc Toan Inland Water Port - operating in Tuyen Hoa district).

Through the inspection of land sector for CP Vietnam Livestock Joint Stock Company - Branch 2 in Quang Binh (implementing an aquaculture project, producing disease-free white-leg shrimp), it was discovered that at the time of inspection, 261,548m2 of land had not been put into use (although the Provincial People's Committee had granted a land use term due to violations of project implementation progress), violating the provisions of Clause 8, Article 81, Land Law 2024.

For Nam Sao Seafood Joint Stock Company: In 2023, the unit had its land recovered (at plot No. 16, map sheet No. 2 with an area of ​​857m2 according to Land Recovery Decision No. 3619/QD-UBND, dated December 15, 2023 of the Provincial People's Committee) but has not yet completed the registration procedure for changes to re-sign a new land lease contract in accordance with the provisions of the 2024 Land Law.

In particular, through inspection at Duc Toan Company Limited, it was discovered that this company had not paid enough land rent with a total outstanding debt of more than 62.9 million VND, violating the provisions of Clause 3, Article 31, Land Law 2024.

In the environmental field, it was discovered that Duc Toan Company Limited and CP Vietnam Livestock Joint Stock Company - Branch 1 in Quang Binh, although the units were carrying out procedures to request environmental licenses (files had been submitted), at the time of inspection, the units did not have environmental licenses as prescribed. In particular, at Duc Toan Inland Waterway Port of Duc Toan Company Limited, there was a volume of hazardous waste generated but the company had not signed a contract with a hazardous waste treatment unit and was storing it at the unit beyond the prescribed time, violating the provisions of the Law on Environmental Protection.

Regarding water resources, the inspection also discovered that CP Vietnam Livestock Joint Stock Company - Branch 1 in Quang Binh did not have a plan to fill in drilled wells when they were not needed according to the law.

The Inspectorate of the Department of Natural Resources and Environment concluded that the responsibility for the above violations lies with the chairman of the board of directors or directors of the companies that own the above-mentioned violating establishments. Through the discovery of the violations, the Inspectorate of the Department of Natural Resources and Environment forced the violating units to take remedial measures and commit to comply with the provisions of the law. If they deliberately fail to remedy the situation within the deadline, they will be strictly handled according to the regulations. Particularly for the case of slow progress in putting land into use (261,548m2 of land) of CP Vietnam Livestock Joint Stock Company - Branch 2 in Quang Binh, the inspection team recommended that the competent authority consider reclaiming the land according to the provisions of the law.

The inspection conclusion requires directors of inspected units to immediately correct the violations pointed out and report the implementation results to the Department of Agriculture and Environment Inspectorate before May 30, 2025.

In particular, the inspection conclusion emphasized the requirement: Nam Sao Seafood Joint Stock Company must register land changes and re-sign the land lease contract in accordance with regulations. Duc Toan Company Limited must pay the full amount of land rent owed of more than 62.9 million VND according to the tax authority's notice; collect, store and treat hazardous waste in accordance with regulations (must not store for more than 12 months, in case of storage for more than 12 months, there must be a written report to the competent authority in accordance with regulations).

At the same time, Duc Toan Company Limited and CP Vietnam Livestock Joint Stock Company - Branch 1 in Quang Binh are required to speed up the progress of preparing documents to propose updating environmental licenses so that competent authorities can consider granting licenses in accordance with regulations. Nam Sao Seafood Joint Stock Company and CP Vietnam Livestock Joint Stock Company - Branch 2 in Quang Binh must exploit and use water resources in accordance with the law; pay all fees and charges in accordance with the law on fees and charges; pay water resource tax, fees for granting exploitation rights and fulfill other financial obligations. CP Vietnam Livestock Joint Stock Company - Branch 1 in Quang Binh must fill in wells in accordance with regulations.

At the same time, the Inspector of the Department of Natural Resources and Environment recommended that the Director of the Department of Natural Resources and Environment direct the specialized departments under the department to consider advising the Provincial People's Committee to consider reclaiming 261,548m2 of land from CP Vietnam Livestock Joint Stock Company - Branch 2 in Quang Binh due to slow progress in land use as prescribed in Clause 8, Article 81, Land Law 2024; direct the specialized departments under the department to continue to guide and urge the violating units to carry out procedures for preparing dossiers to request competent authorities to grant environmental licenses, licenses to discharge wastewater into water sources and licenses to exploit underground water and surface water as prescribed; monitor, urge and guide the violating units to strictly comply with the provisions of law during production and business activities.
