Need to prioritize land fund to build social housing for workers

Kinhtedothi - On the morning of November 21, at the 8th Session, the National Assembly discussed in the hall the Draft Resolution on piloting the implementation of commercial housing projects through agreements on receiving land use rights or having land use rights.


During the discussion session, many delegates agreed with the content of the Draft Resolution to remove legal difficulties for commercial housing projects, remove difficulties in the supply of real estate projects in the context of high real estate prices partly due to difficulties in accessing land for investors. However, many delegates were concerned that the pilot implementation of the Draft Resolution needs to calculate and review the current status of commercial housing in localities as well as its conformity with the approved local housing development plan, urban planning and land use planning...

Delegate Nguyen Cong Long (National Assembly Delegation of Dong Nai Province) said that the Government has been very diligent in promulgating laws related to land and real estate, basically completing the entire legal corridor for the real estate market from the Land Law, Housing Law, Real Estate Business Law. The issuance of another pilot Resolution, accordingly, does not need to meet the requirements of the promulgated laws.

"So there are two legal bases for real estate business. One base fully meets the regulations of the laws, the other base does not need to comply, how will it affect the market?" - delegate Nguyen Cong Long raised the issue.

According to the delegate of Dong Nai province, the real estate market currently has many problems, real estate prices are skyrocketing, the poor, workers, officials, civil servants, and public employees find it very difficult to buy a house. Voters have asked why the National Assembly does not apply this mechanism to social housing, social housing development but only to commercial housing.

On the other hand, the delegate said that with the specific policy in the Draft Resolution, the Government also reported that there are localities where the conversion of land use purposes to commercial housing construction is not a problem. So why must the pilot be conducted in all 63 provinces and cities? The delegate suggested considering the scope, it cannot be implemented widely.

Delegate Do Huy Khanh (National Assembly Delegation of Dong Nai Province) reflected the reality that many localities have commercial housing areas, but there are urban areas where no one lives. Meanwhile, people with low incomes, with salaries of 7 million, 10 million, 20 million cannot afford to buy commercial housing.

The delegate raised the issue, the real need is social housing, why don't we allocate land, don't we make policies for social housing but make policies for commercial housing? From this situation, delegate Do Huy Khanh raised the issue of whether it is reasonable to expand the pilot use of land for commercial housing projects, when the situation of abandonment still occurs. Meanwhile, the real need is social housing, housing for low-income people needs more attention.

"The real need is social housing, why don't we allocate land funds, issue resolutions to develop social housing, meet the aspirations of low-income people, workers, and those who do not have enough money to buy commercial housing?" - delegate Do Huy Khanh emphasized.

Delegate Pham Duc An (National Assembly Delegation of Hanoi) also wondered whether the pilot resolution would create a new land price level. At the same time, the delegate expressed concern that in the same area, the land plots that the State reclaims to implement State projects will have different compensation and reclaimation prices, which will be lower than the price that the enterprise agrees to do real estate projects, even though the two plots of land may be close to each other. At that time, people will compare and disputes will arise.

Speaking at the discussion, delegate Trinh Xuan An (National Assembly Delegation of Dong Nai Province) expressed his support for the adoption of the Draft Resolution and said that the National Assembly's promulgation of the Resolution will be the basis for unlocking resources and increasing land resources for socio-economic development.

Agreeing with the pilot implementation nationwide but not in a general, mass manner, the delegates highly appreciated the design in the resolution for a nationwide pilot but with criteria for each project. In which, with the regulations in the Draft Resolution, it will certainly only apply to urban areas, there is no such thing as taking rice fields and agricultural land in a mass, widespread manner to implement the resolution. "This is a quite reasonable design for implementation" - delegate Trinh Xuan An stated.

According to the delegate, the Draft Resolution received comments from the discussion group, and Article 1 was separated into the scope of regulation and the subjects of application. The delegate suggested designing a separate article on the rights and responsibilities of real estate business organizations. At the same time, it is necessary to add some principles that must be implemented according to the provisions of the Land Law and must not violate the regulations leading to speculation and price increases.

Reporting on the opinions of delegates, Minister of Natural Resources and Environment Do Duc Duy said that he will fully absorb the opinions of delegates and have a full explanation before the National Assembly votes to approve.

According to the Minister, the purpose of issuing the Resolution is to add methods of accessing land for commercial housing that are not currently allowed by the Land Law.

Analyzing the two land transfer mechanisms (the state reclaims land through auction or repossession; people negotiate with businesses or investors whose land they want the state to allow conversion) to implement commercial housing projects, the Minister of Natural Resources and Environment said that current legal regulations still have limitations on land access in implementing commercial housing projects, especially related to small-scale areas of 2 hectares.

"The issuance of the Resolution helps localities, especially those with only small-scale projects with an area of ​​2 hectares that is not yet permitted by law, to remove difficulties in accessing land to implement projects," the Minister of Natural Resources and Environment explained.
