It is necessary to build a Law on Key Industries.

Key industries, which are of great significance in promoting the national industry in particular and the industrialization and modernization of the country in general according to the orientation of the Party and the State, are the fundamental industries, priority industries, and spearhead industries according to the Party's policies and orientations on industrialization of the country.

Resolution No. 29-NQ/TW of the 6th Conference of the 13th Party Central Committee on continuing to promote the country's industrialization and modernization by 2030, with a vision to 2045, sets the goal: Industrialization and modernization must have a roadmap and specific steps, with focus and key points; prioritize resources, have breakthrough and appropriate mechanisms and policies to develop growth poles, foundational industries, priority industries, spearhead industries, supporting industries, and high value-added service industries; prioritize the construction and completion of the specialized legal system on national industrial development and specific industrial fields.

No legal corridor

According to the Ministry of Industry and Trade, the first limitation is that there is no legal framework clearly defining the focus of developing key industries in the industrialization process. The current legal system also does not have specific regulations on identifying key and key industries as well as specific policies to promote the development of these industries.

Second, current laws on enhancing competitiveness for key industries are fragmented, have low legal effect or have not been developed. Market support solutions have not received due attention in the process of developing industrial policies; mechanisms and policies for application, transfer, improvement and innovation of production technology processes in industries.

Third, current laws do not have specific regulations on mechanisms to promote and coordinate policies in a roadmap towards sustainable development in industrial production - especially key industries in line with the development trend of circular economic models, green growth, green and sustainable production.

Due to the lack of a legal system for policies to develop key industries, the organization and implementation of policies and ensuring resources for implementing policies on industrial development in general and key industries in particular are still very limited...

Perfecting the legal corridor, promoting the development of key industries

Therefore, the promulgation of the Law on Key Industries in the current situation and context is extremely urgent to institutionalize the Party's policies and viewpoints on industrialization and modernization of the country in the Resolution of the 13th National Congress of the Party, the orientation for building a national industrial development policy to 2030, with a vision to 2045 in Resolution No. 23-NQ/TW dated March 22, 2018 of the Politburo and most recently Resolution 29-NQ/TW of the 6th Conference of the 13th Party Central Committee on continuing to promote industrialization and modernization of the country to 2030, with a vision to 2045.

Promote the development of key industries in line with the context of science, technology, innovation and achievements of the Fourth Industrial Revolution; aim to build an independent, self-reliant and self-reliant industry, contributing to rapid and sustainable economic development, becoming a developed country with high income in the direction of socialism.

Create a number of policy and legal breakthroughs to address basic bottlenecks in the development of key industries in the direction of moving from breadth to depth, from processing and assembling to research, design and production in Vietnam, with high knowledge and technology content, while creating breakthroughs in the modernization process in industry.

Promote the division of labor and decentralization through creating a legal basis to encourage the initiative and creativity of ministries and local branches in exploiting and promoting the best potential and advantages of the country, each region and locality.

Propose 3 policies

The Ministry of Industry and Trade proposes to develop a Law on Key Industries with the following three policies:

Policy 1: Develop, promulgate and implement the National Program on Industrial Development. The objective of the policy is to overcome the lack of strategy and planning in industrial development orientation in the past; to serve as a basis to ensure feasibility in allocating industrial development resources focusing on key, important, and leveraged industries; to supplement the mechanism for inspection and supervision of the implementation of key industrial development programs and plans.

Policy 2: Enhance the competitiveness of key industries with the goal of improving investment efficiency in key industries; promote industrial development according to the industry cluster model. Ensure consistency with the overall development plan of the country, region and province by industry, occupation and industry cluster.

Policy 3: Sustainable development in industry. The policy aims to improve productivity and quality in industrial production towards sustainable development of circular economy; reduce energy consumption, reduce emissions, green production, respond to climate change... gradually towards meeting the standards of countries with advanced and developed industries in the world.
